Court: Texas had no right to take polygamists' kids 3 minutes ago

SAN ANGELO, Texas - A state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect's ranch.

The Third Court of Appeals in Austin ruled that the grounds for removing the children were "legally and factually insufficient" under Texas law. They did not immediately order the return of the children.

Child welfare officials removed the children on the grounds that the sect pushed underage girls into marriage and sex and trained boys to become future perpetrators.

The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings.

I don’t have a problem with 18th century values! What I do have a problem with is that 31 of these girls are pregnant, and guess what? Many of them are under age to be married in this country! They are either pregnant, or have had children before they are/were 15 years old! Many of them are not even legally married! Don’t you have a problem with that? I do!

I hope that there is enough evidence too. But, if there is any suspicion of abuse, or any evidence at all, shouldn’t they at least investigate it? Many of these ladies don’t know any better. This is the only life they’ve known. They don’t know any better! But if they’ve been coached into lying about it, they must know that many people don’t see it that way.

Why don’t they at least come out and say that they do these things according to their religion? I might respect them more if they did. But still, it’s illegal to marry someone that young! It’s still illegal to marry 20 people! If they don’t investigate it, they’ll get away with it for years to come! Doesn’t that bother you?

Then there is something that is disturbing. A lot of you complain about your/our tax dollars are being used to investigate this, right? Ok, now try this on. From what I’ve heard, I hope it isn’t true, but these men are filthy, stinking rich! Not that there is anything wrong with that. But if this is true, why are they taking these women down to the local welfare office, and getting them to apply for benefits?

They should be able to afford to take care of them! If everything is above-board, why do they have to do that? Doesn’t this use up taxpayer dollars illegally? Then there is that so-called hoax call. There was a ‘hoax’ call made, but it was after the raid! Then there are the people who have left, or have been put out. Are they lying? Shouldn’t they be given a chance to explain? They have some disturbing stories to tell!

Their leader is in prison. He was proven to have done those things they said he did. Do you seriously think this didn’t happen in the recent past? Did you think it instantly stopped when this man was imprisoned? I don’t believe so! There are too many people claiming that this stuff really did happen, and more than likely still is going on. I don’t care if it is 18th century or 1st century values, it’s still illegal!

Of course they’re not abused looking! A lot of them don’t know anything they’re doing/what’s happened to them is wrong! They look and talk like puppets to me. They act like they’ve been brainwashed! It’s more than just keeping them from living 18-19th century values, it’s making people doing illegal things face justice!

If someone you knew and loved was involved with this behavior, wouldn’t it bother you? It would bother me! Especially when young children/teenagers are involved. They can’t get out of it, if they find out most people don’t live like that! Most of them can’t just jump out and escape that easily!

That would be the lynch mob. They will try convict and punish based on some nightly news clips. These are the same ones, who as actual jurors, would convict an innocent person. They will do so inspite of the lack of actual evidence, because if the state said they did it, to them, it must be true. Hang’em.

You are an insult to Texans, True Ladies, Christians and Conservatives everywhere.. you seem like a very lonely, sad, bitter woman who spouts propaganda and gossip as if they were truth. You have not one shred of evidence that you can reference, you’ve been telling outright lies and half truths, and speaking opinions like they were gospel. Are we to believe that old Warren Jeffs was simply the only manipulative bully. Still wanted in Arizona? That all the other old men were squeaky clean?.

I was even more sick listening to Larry King tonight. He seemed to be totally up to feeding nice questions to some of the YFZ people. One thing is sure. The sect is absolutely media savvy.

The authorities as professional people have to keep very quiet as far as the media is concerned.

It has been a long night. I hope to return to the fray tommorrow.

I got ya beat. My great-great-grandfather was 38, and married a woman 24 years his junior (that's 14 for those in Rio Linda). They had 11 kids together (the first was born when she was 18 though). The family story goes that she ran off and got married after her dad slapped her one night.

They were Texans too.

Makes you wonder, today he'd get thrown in jail, but in the mid 1800 they were just another family.

They seek to reprogram the children to accept two mommies or two daddies are ok. To teach them how to use contraceptives, and how to get an on demand abortion when they fail. Or, if they want to keep the child, how to get a welfare check for years on.

When all else fails ,as it typically does in state funded foster homes, the child winds up on the streets as drug addicted prostitutes.

The state in this case, lacking any evidence of abuse, overeached it’s authority. The appeals court put the CPS in it’s righful place.

No evidence? Wasn’t there a little girl whose father somehow got her out of the compound? Then when she did, she told people on national tv that Koresh was going to force her to marry him? I happen to remember that!

So something was going on there, and it wasn’t very nice! It wasn’t just some real nice, fundemental religious family that was only merely living out plain family values! But you’re right, the whole thing was bungled in that situation. That didn’t have to happen the way it did.

At least in this situation, they went peacefully. Their leader was apprehended without hurting the whole compound. The compound was/is all intact. Sure it is sad to me that these children had to be separated from their parents. But what happens if they prove there is something very wrong going on in there? What if they send those children back into that compound, and later on there is more evidence?

How much more evidence is needed? What if they can’t find those kids again? What happens if they get shipped around to other compounds? They might not be able to get access to them again. Then the people doing these alleged things get away with more of it? Then what? Shouldn’t these claims be at least investigated?

From what I understand, it wasn’t just one ex member. It was a number of them. And this included a man who claimed that Jeffs sexually abused him when he was 5 years old! Are all of these people lying? Don’t they deserve due process?

The husbands and wives were married in the FLDS, and none is believed to hold Texas marriage licenses.

Then in the eyes of the law, they were cohabiting, which (whatever else it is) is not illegal.

Thank you for providing details about the McMartin case. As I recall, the “do-gooders” coerced the kids into saying they had been abused.

Which shows what liberal “do-gooders” are really after.

Unfortunately, these Commie fascists never cease trying to gain power on teh backs of little kids, the poor, or whomever else they can exploit. if they can ruin people’s lives along the way, all the better.

There’s no denying the state arrested an entire town to seize all the children. The only question is it’s ultimate goal. The land and structures fully developed now makes it a valuable property. My guess is the state seeks to possess it and all the assets and holdings of all involved.

But it looks like the appeals court has put wrinkle in the state’s scheme to defraud the people of their lives and their properties.

Meanwhile, you’re still fantacizing about some lurid non-existant “temple bed.” A fraudulent scheme intended for audiences like yourself. Some of us are not as easily fooled.
