SAN ANGELO, Texas - A state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect's ranch.
The Third Court of Appeals in Austin ruled that the grounds for removing the children were "legally and factually insufficient" under Texas law. They did not immediately order the return of the children.
Child welfare officials removed the children on the grounds that the sect pushed underage girls into marriage and sex and trained boys to become future perpetrators.
The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings.

Even though a NO evidence would mean I was wrong about my conclusions, as the threads ran, I would rather that be the case. At least I could sleep well, knowing the kids were safe.

Or how about the other CPS lady who stipped search kids without any evidence. She didn’t even report it because it was so routine. She reports having stripped searched 50% of the kids she ‘interviewed’. retrained?

Good analysis. I also think that when CPS realized they had over 500 people living in a coliseum, that they had to do something quickly to get them out of that environment. So then the foster care system took over. And scattered a lot of kids all over Texas, even though CPS said they would try to keep siblings together...
Maybe I’m a little naive, but if I were a mother, no way would I allow a deception to occur that would result in a government agency taking my children away.
You lost me there. Polygamy institutionalizes tribalist patriarchal pagan practices. It creates a surplus of males who become more warlike...and uncontrollable. It's a messy and destructive arrangement on many different levels.

Authorities are not permitted the luxury of acting on their feelings. They are supposed to act with logic and reason and within the confines of the law.
They *felt* that the parent's beliefs were a threat to the children and filed their paperwork to that effect. The appeals court said that this was against the law. Period.
In America, we don't prosecute people for their beliefs. Only for their actions. CPS did NOT cite *actions* as their reasons for taking the children. They cited the parent's *beliefs" as the crime.

First, I haven’t read an article mentioning that yet.
Second, the media likes to whip up the stories to sell more laundry detergent.
Third, just how do you go about looking for bruises on children who are wearing longsleeves, and dresses to the floor?
My understanding is that a lot of the FLDS women are tiny and petite. Talk about a nightmare for the CPS. The problem for the CPS is that they screwed up and took adults too. That just happens to be a Federal offense under the Color of the Law, which may be punishable by the death penalty.
There is no way that the FLDS could have anticipated a raid like they received. But I would be willing to place a large wager that they anticipated an investigation and raid at some point. Being investigated for them is probably a normal cost of doing business.
The comments about retraining are really bothering me. Its as if you don’t support any consequences for government officials when they go off the reservation.
They are abusing their power, impacting peoples lives, ruining peoples lives, and breaking the law. Yet you consider retraining to be the answer?

I in no way mean to be derogatory to the FLDS members.
But I think if one wants to understand what the CPS had to deal with, one should try walking in their shoes.
Listen to the men and women of the FLDS speak, and draw your own conclusions.
