Boy, 10, charged with rape

A 10-year-old Marion County boy has been found mentally incompetent to stand trial on delinquency counts of rape and gross sexual imposition. Marion County officials declined to provide details about the case, but a Prospect-area woman says the boy molested her 4- and 6-year-old sons last summer.

The woman is upset that the 10-year-old continues to attend the same Prospect school, South Elgin Elementary, as her 6-year-old first-grader.

"I'm furious, but my hands are tied," the woman said yesterday. She considered enrolling her son at another school, but he begged to stay at South Elgin with his friends and teacher, she said.

The woman said she met with school officials after obtaining a protective order requiring the 10-year-old to not speak with her son and not come within 8 feet of him.

Elgin Superintendent Doug Ute said school officials are aware of the charges against the boy.

"We are very concerned about the safety of all our kids and take the necessary steps to ensure that. Our kids are safe," Ute said.

Asked whether the parents of other students are aware that the boy is attending classes while charged with sex offenses, Ute declined to comment.

The mother of the two younger boys said she worries about the safety of other children.

The mother said her husband saw the 10-year-old molesting her sons on July 8 when he walked by a window at their home and glanced inside.

The Dispatch does not identify sexual-assault victims and is not identifying the defendant because of his extremely young age.

Marion County Family Court Judge Thomas Jenkins, who called the case unusual because of the 10-year-old's age, said psychiatrists believe treatment can help the boy be declared competent so he can face the charges.

Jenkins said he sees no danger to other children because the boy is receiving mental-health treatment. "I feel very comfortable the community is protected," the judge said.

Prosecutor Jim Slagle confirmed that the boy was charged in November but said he could not discuss details because the case is pending.

Slagle said he was unaware that the 10-year-old is attending school with one of the alleged victims. "That's a concern, yes," he said.

Two Marion lawyers representing the 10-year-old -- Jon Doyle and Robert Wilson -- could not be reached yesterday for comment.

If you've got a 10 year old boy molesting younger kids, it's a pretty sure bet that kid was (or is being) molested himself.

I do wonder why the mother did not insist on her son changing schools if the boy who molested her son is still attending.

We'll hear from this kid again when he's 14, 15, 20, 30...it'll be the same story each time: "He's not a threat because he's getting mental help."

Garbage! Get him out of the school and away from the kids he molested.

The article said she didn’t want to take the child away from his friends and favorite teacher. I wonder why the mother of the 10 year old doesn’t take her child out of the school.

In other words the little sicko's attorney is playing the only card he has. I don't know anything about Ohio's facilities, but back in the day it was difficult to place 10 year olds in Texas. He'll probably end up in a group home much like a halfway house with kids who've been charged as chronic runaways or truancy or some other lighter crime. Depending on his behavior, he might be moved to a more structured state facility once he's a bit older. That, or he'll be released since he's so young and kids can get away with murder with a mere slap on the wrist.

Yes, but as a mom, I couldn't see allowing my son to attend the school with his molester. It appears she has tried to get the molester removed to no avail. At that point, I'd have to overrule what my son wanted and move him to a different school. (Or perhaps home-school or have him tutored at home until the problem is resolved.)

The best thing would be for the alleged molester to be tutored at home until this is resolved. I also believe there needs to be a thorough investigation of his home life. Something is going on there for a 10 year old to be molesting younger kids.

Same thing happened here in Anchorage last year. The school district tried like the dickens to cover it up protect the children. One of the points in the entire episode is that the teacher failed to note "little Johnny' was missing from class - for 45 minutes. He was in the head molesting 2 other students.

The teacher is still working at the school, and "little Johnny" is still a student. Mainstreaming / inclusion / or whatever name they use this year is clearly not for every student. http://www.springerlink.com/content/j384387224j35624/

If I interpret this correctly, it happened in their own house.

I’d say that the parents should no longer leave their 4 and 6 year old sons alone with a 10 year old who is mentally retarded.

Why wasn’t ‘little Johnny’ expelled? And why wasn’t the 10-year-old rapist (it was hard to even type that) expelled? Kids get expelled for far lesser crimes. How is it that these young rapists are still in school???

The molestation happened in the kids' house, not the school. Molestation can happen anywhere there is inadequate supervision.

AH. but you see, little Johhny is protected by the ADA - after all, he is “Special” as in special ed.

MY wife works at a school and they found a loaded gun on the little ( OA:%*(*%(#) and the little darling was back in school two days later.

Had he shot and killed my, he ***might*** have gotten some jail time. (Assuming he lived long enough to go to trial)

THe ADA is the single most perverted piece of law passed by Congress in the last 50 years.

ADA is Amercans with Disabilities Act. It’s the law that made companies deal with disabled people both in employment and with access.
