Sara Jane Olson's release from prison and sudden return to custody may have caused lasting psychological damage and she should be released at once because her right to due process was denied, her lawyers contend in a petition filed Tuesday in Sacramento, Calif.
Olson's attorneys said the California Board of Parole Hearings acted illegally last week because it never revoked or suspended Olson's parole -- steps that would require a hearing.
California corrections officials blame her early release on a calculation error caused by a failure to read an entire transcript. They say she legally has another year left to serve.
Olson's lawyers say, at a minimum, she should be released pending a hearing.
'Huge emotional toll'
"The board's action took a huge emotional toll on Olson and her family," the petition states. "After being released from prison for five days, Olson was literally snatched by the board in the dark of night and imprisoned without notice, without a hearing and without an explanation.

Wonder what the family of the victim who died during her bank robbery is going through right now with ‘lasting psychological damage’??

Well, if she has "lasting psychological damage" she could be a danger to the public at large, as well as family. Better keep her locked up to be sure!
am I the only one who is getting this.. a parole board cannot let someone go then re-arrest them without revoking or suspending their parole...the parole board f’ed up. They broke their own rules.. the question here isn’t what her punishment should have been, the question is did authorities break the rules...the answer is yes. How about due process people? Aren’t we all entitled to that? I don’t like criminals either, but what I like less is government authority that can’t follow its own procedures.

Here’s my take........The judge’s order said (minimum) seven years, not six. The parole board screwed up, no doubt. They cannot even consider her for parole for seven years. They cannot override the judges order......

Her release came as a shock, he said. “It was a surprise.”
Can you explain the rule that they broke? This isn’t the first time a felon has been released and reapprehended due to a bureaucratic error leading to an early release. So please explain your position.

In order to revoke parole, there must be a hearing. Period. It doesn't matter that they mistakenly gave her parole, they did it.
The argument that she should be set free now it obviously ridiculous, but the argument that she was denied due process is legitimate.
The officials that decided that taking her back into custody without setting a hearing violated the law.
