I attended the townhall meeting earlier today in Polk City and asked John McCain:
Your Hispanic Outreach Campaign Advisor, Juan Hernandez, has written a book referring to illegal immigrants as “New American Pioneers.” Hernandez has also stated that illegal immigrants who use social security numbers of American citizens really don’t steal, they have no choice but to make up a number. Are you aware of his statements? Do you agree with him? If not would you consider removing him from your staff?
John McCain answered that he supported Juan Hernandez because he holds the same views as he (McCain) on other issues. He says that he determines his positions and Hernandez agrees with him, not the other way around. He appeared to be unaware of the specific positions of Hernandez that I related.
I would say I got a non-answer. I did not get a video but all the media were present.

Mike Huckabee is cut from the same cloth as Bill Clinton. The fact that he has an (R) behind his name is coincidental.

This is the main statement:
With respect to loss of nationality, 349(a)(4) of the Immigration and Nationality Act (INA), as amended, is the applicable section of law. Pursuant to 349(a)(4), accepting, serving in, or performing duties of in a foreign government is a potentially expatriating act. In order to come within the Act, the person must either be a national of that country or take an oath of allegiance in connection with the position. Thus, the threshold question is whether the person's actions fall within the scope of this provision. Information used to make this determination may include official confirmation from the foreign government about the person's nationality, and whether an oath of allegiance is required
The rest of the page is somewhat subjective in its content. Basically, it says that individual cases are examined for intent, which is somewhat limp, considering that it allows the dual national to do whatever he wants. But then it does point out that an earlier AG opinion makes the assumption that a dual national taking a position of trust in a foreign government can be assumed to be expatriating himself.
The final decision would appear to be a function of the State Department.
The relevant law is 8 USC 1481.
I would say that unless he has been extremely diligent about maintaining appearances, Sr. Hernandez is surfing right at the edge of expatriation, and might have a hard time proving that he hasn't already gone over the edge.
Apologies to any who feel I am spamming this message on campaign threads, but it is an important message on a key vote which needs to get out.
Once again, we have reason not to vote for John McCain.

You’re entitled to your opinion. I don’t think it will matter much after next week. Huckleberry is broke and after his distant third place finish there’s just no reason for him to go on...other than as a stalking horse for McCain which is the role he’s obviously playing now.
