Well, it can be exactly like attempted murder if it doesn’t actually kill the child.

I’m for the death penalty in this case.

In this case, the best answer is YES.

There is absolutely NO reason for a grown up to rape anyone, much less a child, other than that the rapist wants to forfeit his/her life. And the Supreme Court would be correct in agreeing that death is not "cruel and inhuman" judgment for a child rapist.

My only concern is will this lead to the death of more children. Why leave a living witness if the punishment is the same?

I have mix feelings about the death penalty for rape.

On one hand I think that the crime definitely deserves the death penalty.

On the other hand the death penalty leaves the criminal with the incentive to kill his victim in order to ensure their silence. The death penalty leaves the perp with nothing to loose.

I agree with you except the Supreme Court has not business deciding what society(the people)should decide.

What I fear most with putting this before the Supreme Court and say they rule in favor is somehow and somewhere criminals like this will be put in the protective side of the law and will continue for years not really being punished.

I say put these scum in jail and let that particular part of society deal with them. And make sure they are in the general population of the jail. Now that should take care of the situation and faster than any laws the courts will make.

As heinous as child rape is, you hit the nail on the head with the problem of imposing the death penalty on such rapists. It leaves them no alternative but to kill the sole witness to the crime, thereby making it even more difficult prosecute the crime. I would say the death penalty is extreme because of the worst case.

Now, sending them to the worst penal institutions possible and putting them among the main prison population and letting justice be served otherwise..... well, the punishment would fit the crime.
