A US woman who was facing jail for swearing at her toilet has been acquitted.

Dawn Herb, 31, of Scranton, Pennsylvania, was charged after an off duty police officer overheard her swear at an overflowing toilet.

I read the article and looked at the picture of the toilet. It looks like a residential bathroom, inside a private home. How can a police officer control a citizen using free speech inside her home?

Was it a public toilet or her own toilet in her house? If it was hers in her house, she must have been yelling pretty loudly for him to hear her out on the sidewalk/street. The picture makes it look as though it was her toilet.

With the utmost respect to the victim, she does look like she has abused a few toilets in her life. The cop was trying to give the toilet a break.

The most egregious case of a crime against an inanimate object that I am familiar with occurred here in Lubbock back in the late 70s.

A gentleman had stopped at a closed service station to get some cigarettes from their outdoor vending machine (this was back when such things still existed). He deposited his 75 cents but did not get his smokes. Incensed, he drew a .357 magnum revolver and fired all 6 shots into the offending machine. A policeman happened to be passing by and promptly arrested the enraged smoker.

I never did find out what became of his case.

The judge dismissed the case. Good thing. It would have been nearly impossible to find 12 people who had never swore at a plugged up toliet to serve on the jury.

Theoretically she faced jail. Any summary offense in Pennsylvania carries a potential sentence of up to 90 days. She almost certainly (99.99999999999999 out of 100)would have been just fined. I agree though that cursing should not warrant a summary offense.
