Massachusetts Magic: Felons Doing Disappearing Act

It turns out Deval Patrick was right about Massachusetts. Magic can happen here. Just ask Vith Ly.

Ly is the Cambodian immigrant who kidnapped and raped a co-worker in Lowell when she spurned his affections. In 1990, he was sentenced to three 20-year stretches in MCI-Concord, but a liberal Massachusetts judge set him free on bail while he waited for an appeal.

Ly lost the appeal and the court ordered him to serve his hard time. But Ly never showed up. An immigrant, a convicted criminal - Ly’s life was looking pretty lousy.

And then the Massachusetts Miracle.

The Middlesex district attorney never bothered to go get Ly, so he never bothered to show up. He got a job, he got married, he even got arrested for assault - twice! But he never served another day.

After 16 years, however, it appeared Ly’s luck had ran out. After a routine traffic stop, someone in the amazingly incompetent Middlesex County DA’s office finally put the facts together.

The moment for justice had arrived, a rapist would get his lawful punishment and the victim of his violence would be avenged!

Ooops. Did I mention this was Massachusetts?

Presto chango - suddenly the bad guy wasn’t the rapist. It was the inept prosecutor.

“This man has gotten married, paid taxes, had three children,” Judge Hiller Zobel complained. “Now, all of a sudden he wakes up and the government wants to put him in jail?”

Such is the “magic” of the Massachusetts justice system that instead of punishing Ly for ignoring a guilty verdict, Zobel released him. The judge gave him, and I quote, “credit for time served while he was free.”

You can “serve time” and “be free” simultaneously? So are all the citizens of Massachusetts serving time now? Or is it just us married guys?

If none of this legal hocus pocus makes sense to you, you’re obviously not a member of the Supreme Judicial Court. Declaring that a felon has “no obligation to come forward voluntarily to be incarcerated,” the SJC returned this rapist, unpunished, back to the streets of Lowell.

And I’m sure he spent those 16 years worrying about whether the authorities might come and get him.

Hell, I think the state ought to PAY poor Ly for those 16 years of pain and suffering!!

And the incompetent Middlesex County DA that oversaw Ly’s vacation is now Attorney General. But she’s a media whore and that’s what counts in this state.

I don’t pretend to know Massachusetts Constitution, but is it not the Legislature that has the duty to impeach and remove from office this incompetent Judge?

There was a lot more going on in the Eappen case than meets the eye.

Poor little Matthew was not even sitting up by the age of 6 months. He may have been abused but it’s not clear that the baby sitter did it.

So the Mass SCT says,”no obligation to come forward voluntarily to be incarcerated,”

Excuse me, but I thought that was the express condition of bail.

Coakley is also the one who went after the Amiraults.

MA was the only state in the union that didn’t pardon the defendants in those daycare center witch trials.

I'm still convinced she did do "something", as were twelve jurors. And although manslaughter may have been a more appropriate charge, the fact that Zobel let her walk is still an abomination.

I went to High School with Cheryl. Her and her mother were railroaded. Tookie I am not so sure about.

ROTFL! You mean the overwhelmingly Democrat legislature that doesn't even have the guts to send a referendum on 'homosexual marriage' to the voters? Not ruddy likely.

This effin' judge is behind so many of these outrages. I'd read such comments from him when I was living up there, that when a big case was in the offing, I'd pray he wasn't the Judge.

You can be sure though, if his daughter were the victim, he'd have a different attitude.

Its another reason I’m always incredibly suspicious of ‘successful’ Blue State Republicans. If they managed to get liberals to vote for them, why would I think they could also get MY vote?

But as for this travesty of justice, was there no comment from the victim in this story? Apparently, being a victim is only valid when you are a victim of some political crime and not an actual crime like rape or murder? Strange kinda world these people live in.

The entire Amirault case is a stain on the reputation of the Commonwealth of Massachusetts.

I’ve read the transcripts of the interviews with the children. To say they were coerced is an understatement. Even if Tookie is guilty, I don’t think he was, but even if he is the interview techniques should have had the case thrown out.

Coakley was an out-of-control DA. She let Cheryl and her mother out of jail on the condition that they never talk to the media. What was she afraid of? Maybe the truth would have come out.
