Poteet Mayor Reverses Decision To Resign After Child Indecency Plea
Last Update: 10:22 am

SAN ANTONIO (AP) -- The mayor of Poteet says he no longer plans to resign over his guilty plea to child indecency charges.

Lino Donato pleaded guilty last week to two counts of indecency by exposure and no contest to one count of indecency by contact for incidents between 1996 and 2000.

Donato's guilty plea cut short his trial on accusations he exposed himself to two girls and improperly touched one of them.

He planned a meeting today to resign as mayor of the town about 30 miles south of San Antonio. But Donato has now canceled it.

He says he's not guilty, didn't do those things and needs to clear his name.

He's still eligible for office because he was sentenced to deferred adjudication probation.

Donato, who must register as a sex offender, is in his third term. It ends in 2009.

Did it happen in an airport bathroom?

To be fair, the events apparently happened over a decade ago and he’s going through a divorce—some chatter in previous stories that his wife is out to get him.

Don’t kill the messenger ;)

This slime pleaded guilty. Just like the man I used to support, Senator Larry Craig. Guilty means "I did it, and no trial is necessary." People who are not guilty, or who claim they are not guilty (think O.J. Simpson) plead "not guilty." That's how it's done.

And how many of those who plead "not guilty" really are "not guilty?" (I think of Wenatchee WA, having met one of these folks.)

I did trial law in District Courts for several years. Most (about 90%) of all defendants who plead "not guilty" are, in fact, guilty. I got tired of defending the guilty, and got out of criminal law.

Joke on Brian and the Judge this morning:

Which lawyers are happy?

The ones not practicing law.
