I don’t accept this as GOOD news but it’s better than what it could have been. Early on Freepers were saying if the boots on the ground can be charged with killing civilians then the same should be applied to the pilots for bombing and taking out lives from results of a blast. I don’t believe the Marines or the pilots should be charged, but the outcome is the same: dead people in war.

The official, Lt. Col. Paul Ware, said in a recommendation obtained by the North County Times that rather than face murder charges, squad leader Staff Sgt. Frank Wuterich should be tried for the lesser offense of negligent homicide in the deaths of five children and two women.

I believe that the correct legal term for this is bullshit.

Looks like general Mattis will have to decide once again. Hopefully these remaining four shall be fully cleared. I hate to see this young Marine Sgt. get stuck with even negligent homicide charges after all we have been detailed with.

Negligent homicide? How can that be proven?

Mattis should dismiss the whole case and completely exonerate SSG Wuterich.

Maybe that’s what Ware is working toward here.

Former Marine Corps judge and prosecutor Gary Solis, now a military law professor at Georgetown University, said the outlook for Wuterich is a lot brighter now.

No man's ego can endure the gravity of truth.

Aired September 1, 2007 - 11:00 ET (CNN)

JAMIE MCINTYRE, SENIOR PENTAGON CORRESPONDENT:
GARY SOLIS, MILITARY LAW PROFESSOR:

MCINTYRE: And that might help explain why so far prosecutors have had trouble making murder charges stick. Charges have been dropped against two marines, another is waiting a decision. Is there a tendency to give marine soldiers in combat a benefit of a doubt?

SOLIS: I think that's another problem in this case. You have a military jury, probably most of whom, if not all of whom, will have been in Iraq.

..

SOLIS: It would be difficult to say that justice has been served if no one is convicted for Haditha.

-------------

In my view, it's difficult to tolerate self-indulging speculation at the expense of the U.S. Marines.
