CNN: Flying Mexican Flag Over US Flag Is OK

A Mexican bar owner in Reno Nevada flew the Mexican flag above that of the United States. Only problem is that this is specifically illegal under United States Code Section 7, Title Four, which states,

(c) No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy. No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof: Provided, That nothing in this section shall make unlawful the continuance of the practice heretofore followed of displaying the flag of the United Nations in a position of superior prominence or honor, and other national flags in positions of equal prominence or honor, with that of the flag of the United States at the headquarters of the United Nations.

The brazen effrontery of the bar prompted an American veteran to cut down both flags. But when CNN reported on the event, they managed to significantly skew the perception. The CNN report simply states that the veteran was angry that the Mexican flag was placed above that of the US- no mention was made that it was in fact illegal under US law. CNN compounded their offense by showing in their video clip, not the actual words of the relevant US code that outlaws this action, but instead 'flag rules' taken from USHistory.org, thus downplaying the actual offense, by suggesting that athe law is in fact merely recommended behavior. As in so much relating to the illegal alien lobby, apprently it is OK with CNN for immigrants to disrespect and/or disobey the laws of our country, but let one American try to react, and they scream bloody murder. (g) When flags of two or more nations are displayed, they are to be flown from separate staffs of the same height. The flags should be of approximately equal size. International usage forbids the display of the flag of one nation above that of another nation in time of peace.

Public Law 94-344, known as the Federal Flag Code, contains rules for handling and displaying the U.S. flag. While the federal code contains no penalties for misusing the flag, states have their own flag codes and may impose penalties. The language of the federal code makes clear that the flag is a living symbol.

In response to a Supreme Court decision which held that a state law prohibiting flag burning was unconstitutional, Congress enacted the Flag Protection Act in 1989. It provides that anyone who knowingly desecrates the flag may be fined and/or imprisoned for up to one year. However, this law was challenged by the Supreme Court in a 1990 decision that the Flag Protection Act violates the First Amendment free speech protections.

OldSmaj, you’re just wrong. It’s not against the law to fly a foreign flag over our own flag. It’s an insult and a shame, but it’s not a crime. As much as I share your hatred of flag desecration, if you trespass on private property and destroy someone’s flag, it will be YOU that will be facing criminal charges, not the flag owner.

On CNN’s American Morning, John Roberts and Kiran Chetry discussed this issue, and they put the US Flag Code on the screen that pertains to this particular situation. From what I could tell, the code clearly states that having the Mexican flag above the US Flag is in violation of how flags should be displayed. Kiran and John seemed to be supporting the man who was angry about this instead of bashing him. I’m not one to stick up for the libs on CNN, but on this particular program they gave a fair representation of this story.

That is nice, but you have still not cited a United States law that prohibits such an act. Instead, you cite the Flag Code which has not penalty provision, thus is not a law as for example, theft.

Apparently, Pahrump Nevada made it illegal to display a foreign flag unless a US Flag is flown above it. (per cnn’s link under the google results page)

NRS 118A.325 Right of tenant to display flag of the United States in certain areas; conditions and limitations on exercise of right.

1. Except as otherwise provided in subsection 2, a landlord or an agent or employee of a landlord shall not prohibit a tenant from engaging in the display of the flag of the United States within such physical portion of the premises as that tenant has a right to occupy and use exclusively.

2. The provisions of this section do not:

(a) Apply to the display of the flag of the United States for commercial advertising purposes.

(b) Preclude a landlord or an agent or employee of a landlord from adopting rules that reasonably restrict the placement and manner of the display of the flag of the United States by a tenant.

3. In any action commenced to enforce the provisions of this section, the prevailing party is entitled to recover reasonable attorney’s fees and costs.

4. As used in this section, “display of the flag of the United States” means a flag of the United States that is:

(a) Made of cloth, fabric or paper;

(b) Displayed from a pole or staff or in a window; and

(c) Displayed in a manner that is consistent with 4 U.S.C. Chapter 1.

No, I'm supporting the vet's freedom of speach/expression, and actions speak louder than words.

...and are opposed to property rights as they are advocating theft of flags.

No, I'd consider that a "rescue" not a theft. I'd probably have burned the Mexican flag though...

I fail to see in the Constitution where any one citizen has greater First Amendment Rights than the next citizen.

However, theft is theft and it does not matter if one steals a car or a flag, it is still against to law.

"I might be wrong but I really don’t think there is a United States anymore. I can’t find any obvious indications that the U.S. still exists. I think everyone has “globalized” themselves.

Very sadly, I'm beginning to think this is true. One thing is certain, the United States definitely doesn't exist in the way we've always known. Our country is rapidly becoming a shadow of its former self.....
