September 4, 2007 -- He got off - on a technicality.

Five times last year, porn actor and registered sex offender Kenneth Hoyt allegedly exposed himself and started masturbating on Manhattan subways - once in front of two 16-year-old girls.

But the whole bundle of misdemeanor charges - including seven counts of public lewdness, one count of indecent exposure and two counts of endangering the welfare of a child - were dismissed by a criminal court judge last week.

The reason? Prosecutors with the Manhattan District Attorney's Office missed the legal deadline for bringing the Hell's Kitchen perv to trial in a timely manner - by only four days.

ADA Amir Vonsover, who was the lead prosecutor on the case, conceded it was now too late to bring Hoyt to justice.

Hoyt left court smiling Thursday after his legal windfall. He declined to comment except to say he enjoyed the prospect of the District Attorney's Office being embarrassed by their snafu.

"That'd be good," he grinned.

Hoyt, who lives on Ninth Avenue at 49th Street, was arrested in 2003 and 2004 for prostitution, aggravated harassment and lewdness.

He has been a level-three registered sex offender since his 1986 California conviction for having sex with a 13-year-old girl.

Prosecutors had found seven women and girls who recognized Hoyt as the lewd exhibitionist who'd flashed them during subway rides on five days last spring and summer.

Question: The reason why public lewdness, indecent exposure and endangering the welfare of a child are misdemeanors is what, exactly?

The same thing occurred to me as I was reading.And to think that here in the Gay State there's legislation pending that would make the altering of a handicapped parking placard a *felony*.

Liberal incompetents run the Manhattan DA's office... they can't seem to file a criminal case on time - so justice is thwarted. Hey, where's Charles Bronson's Jack Kersey when you need him to make short work of criminals and the liberal justice system that coddles them?

I believe that the Press is required to use that qualifier when reporting on someone who hasn't been convicted.

I've noticed that reporters (news readers) often use it even when speaking of someone who's been convicted. They don't even realize what they are saying.

I've noticed that reporters (news readers) often use it even when speaking of someone who's been convicted.

They even use it when speaking about the late Seung Hui Cho, who is alleged to have killed some people at VA Tech. After all, who are we to judge?

What is the big deal? We have queers kissing on TV and promoted by hollywood as nice and normal with nambla still lurking in the closet but parading in San Fransicko. If you think this is bad, take a look at what goes on in public parades in front of little kids. These sickos are in grade schools now trolling for young boys while promoting their sickness to the very young (6-8 year olds).

Ninth and 49th is in the heart of the Theater District with most buildings being of the old-style brownstone type...4-6 floor walk-ups.

Sorry, I just don't believe in rewarding incompetence with continued employment. If they cannot juggle the case load and get the job done, then hire more employees, don't just let trash back out on the street - period.
