Democratic activist sues over loss of Florida delegates

TAMPA, Fla. -- A Tampa Democratic activist sued the national and state Democratic parties in federal court Thursday over the national party's decision to strip Florida of its delegates for next year's presidential nominating convention.
Seeking to penalize Florida for moving up its primary election to Jan. 29, the Democratic National Committee's rules committee voted Saturday to take away Florida's 210 votes in the national nominating convention in Denver next summer.
Political consultant Victor DiMaio, who serves on the Hillsborough County Democratic Executive Committee, claims in his lawsuit that the action violates his constitutional rights.
"Right now we have zero delegates, so we have no voice" in choosing the Democratic nominee for president, DiMaio said.
The suit, which names the Democratic National Committee and the Florida Democratic Party as defendants, seeks clarification of the law.
"We're asking the courts to determine whether the national party rules supersede states' right to set a primary," said DiMaio's attorney, Michael Steinberg.
U.S. Sen. Bill Nelson and other Democratic members of the Florida congressional delegation have also threatened to take legal action.
The Democratic National Committee said they are within their rights.
"Florida has the right to determine its primary date. However, the Supreme Court determined more than 25 years ago that the Democratic Party has the legal right to establish the rules by which they select and seat delegates to the National Convention. We continue to hope that Florida will do the right thing and come up with a plan that's in compliance with the rules the DNC and its members from Florida voted for," said DNC spokeswoman Stacie Paxton.
A spokesman for the Florida Democratic Party said he had not seen the lawsuit late Thursday afternoon.

LOL — lawsuit will go nowhere, but at least it’ll suck up some dollars that might otherwise be spent on campaigning, so there’s a tiny silver lining. :-)

Another silver lining could be — and I’d like clarification from anyone who knows better — that taking a somewhat conservative, (sort of) southern state out of the nominating process will encourage the Dems to nominate a lib who can’t win in the general.
To quote Henry Kissinger, “Too bad both sides couldn’t lose.” (I think it was Kissinger.)
Political parties are NOT Constitutionally protected entities, nor indeed mentioned at all in the Constitution.
Memo to this dildo: A) read the Constitution, B) read the Federal statutes concerning elections, C) attempt to propel certain renal byproducts vertically along a section of woven hemp.

If all states were in compliance, how many total delegates including at large delegates, are there at the Democrat convention?

The case doesn’t have a chance. There are no political rights protected by the constitution. He might make the state democratic bosses squirm a bit trying to explain how they are going to fix this. What you will hear about within four weeks...is a series of meetings to be held in each county...probably on a Saturday in March...which they will simply do a ballot-stuffing game to satisfy the Democratic voters in Florida...to ensure Hillary wins.
I personally am tired of this Iowa/New Hampshire game...and think it doesn’t do justice to the nation. I’d rather see the 50 states arrange a primary schedule around April...where all 50 states vote in the first two weeks of the month. What they are getting upset about is the huge amount of power that two lousy states have on the entire election...and the national politicians are so stuck on this idea of playing out the game like this.
This will get SO MUCH attention in the LameStream Media. Not.
Oh yeah? Well, I bet there is at least three (maybe even one or two more) Supreme Court Justices that can "find" it in the "Penumbra" if they are told to! /s
Nothing will come from it but it will help to have them spend their rubles on lawsuits instead of paying for their voter fraud operations.
