A federal judge has put a halt on a planned White House crackdown on employers who hire illegal immigrants while she considers a lawsuit filed by the AFL-CIO claiming the move would harm citizens and those working in the U.S. legally, the Washington Post reported on Saturday. Click here to read the report from the Washington Post. The ruling, issued by U.S. District Judge Maxine M. Chesney, bars the Department of Homeland Security from sending mail notices to 140,000 employers about suspect Social Security numbers. The AFL-CIO and the American Civil Liberties Union say that DHS is going beyond its mandate to enforce immigration laws and is misusing the Social Security Administrations database, according to the report. "We're disappointed by the delay and expect to prevail once the court has the benefit of full briefing and argument," DHS spokeswoman Laura Keehner said. She added that Homeland Security will continue other immigration enforcement programs. The ruling allows Judge Chesney to review the lawsuit before issuing a decision on the DHS plan. A hearing on the case has been set for Oct. 1.

Blatant overreach and violation of the separation of powers.
Its the 9th Circut. As they say, you cant find American law and 9th Circut opinions in the same place.
I noticed too that when the Bush administration wanted to allow Mexican trucks to roam our highways, they too went to the 9th Circut. You can count on those judges to work to destroy this country.
Stupid AFL/CIO....the plan can NOT be enforced anyway.
... and a great example of what would go wrong with the Blanket Amnesty Act of 2007. Judges like that one would strip all the enforcement side out of the law, leaving nothing but amnesty in its wake. “ENFORCEMENT FIRST, then we’ll talk. WE DON’T TRUST THE SYSTEM and with obvious good reason.”
Why, oh why, oh why are so many of these screw ball judges dames?? (Being a femme I can say that)
Well of course a federal judge did. Of course. I am sure that the White House will issue a statement detailing how disappointed they are at this delay of justice for the American people.
The Government-Political Complex will be shocked when Americans get so fed up with the BS that they just burn the whole damn thing down and order the entire membership of the federal whorehouse to go home-stay home.
The proper response here would be to impeach the judge.
It might not actually pass—but it would certainly cause the judge trouble AND EXPENSE.
What exactly "is" it with these judges?? Is it time yet to get out the tar and feathers???
What a surprise....
HONORABLE MAXINE M. CHESNEY
Judge of the United States District Court,
Northern District of California
Judge Maxine M. Chesney graduated from the University of California, Boalt Hall in 1967 and began her eleven year career in the Office of the San Francisco District Attorney. She was appointed to the San Francisco Municipal Court in 1979 by Governor Jerry Brown and to the Superior Court in 1983.
In 1995, President William Jefferson Clinton appointed her to the United States District Cout, Northern District of California. Judge Chesney has been a featured speaker in seminars through-out California for more than twenty-five years.
Yes and no. Yes it is time to take action but no, pee-cee will not allow THAT action.
Since suing will not faze these whores and physical action is not allowed, they will sit there fat, dumb and happy until the mobs with the torches show up. At that point they will all be "shocked."
The ordinances of Hazleton were passed for the health and safety of town residents. They applied only within the town. In attacking those ordinances, the ACLU also attacked both parts of that statement from the Declaration [After stating our God-given rights, the Declaration of Independence recites our basic political rights, stating that governments derive their just powers from the consent of the governed. That when any Form of Government becomes destructive of these ends, it is the Right of the People to alter or abolish it....]. No surprise. But here, a federal judge joined in the attack.
He is not elected. And yet, he substituted his political views for those of the people, who had just reelected their mayor by causing him to win both primaries, Republican and Democrat. There was no doubt whatsoever where the consent of the governed lies. On the other point, the judge assumed that he had somehow obtained the power to overrule the people.
====================
I submit that the recent dust-up over illegal immigration CLEARLY showed the will of the People.

Gee, I ponder how much this bribe cost, and who was the source?
“... and a great example of what would go wrong with the Blanket Amnesty Act of 2007.”
That’s what happened to the 1986 amnesty agreement!!!!!!
This is exactly why I do not trust my government. Nothing is EVER what it seems to be.
I think the only way to fix activist judges is to have a law that states that any judges rulings that are overturned due to activistism, to be penalized $25,000. I cannot see how corporations can be penalized for incompetence and yet the judges are immune from it. It would stop activist judges in their tracks! Now How you would nail Stephesn, Bryer and Ginsburg is another problem.
The policy enunciated by these new-form letters is not based on new law, just a new intention to enforcing existing laws. The new letter is just a reminder of the existing law and the proper procedures to observe it.
As far as I can tell, there is absolutely no reason not to do exactly what was planned, and execute the appropriate sanctions against both employers and illegal alien employees alike. Unfortunately for them, the judge has made a warning to them impossible. Too bad, so sad.
This will only slow things down for a month or so. Even if the “9th Circus” does make a ridiculous decision over 80% of their cases are overturned by the Supreme Court. Even the weather guy is correct more often.
This desperate move just shows us that the “bad guys” are worried about this enforcement measure.
“Well of course a federal judge did. Of course. I am sure that the White House will issue a statement detailing how disappointed they are at this delay of justice for the American people.”
The White House knew this would happen. They were counting on it.
