DURHAM, N.C. — A judge has sentenced disgraced prosecutor Mike Nifong to one day in jail for lying to a judge while pursuing the Duke lacrosse rape case.
Nifong was held in criminal contempt of court Friday for lying to a judge when pursuing rape charges against three falsely accused Duke University lacrosse players.
Superior Court Judge W. Osmond Smith III immediately moved to consider a punishment for Nifong, who has already been stripped of his law license and has resigned from office. He faces as many as 30 days in jail and a fine as high as $500.
Reading his decision from the bench minutes after the conclusion of two days of testimony, Smith said Nifong "willfully made false statements" to the court in September when he insisted he had given defense attorneys all results from a critical DNA test.
In fact, Smith found, Nifong had provided the defense with a report on the DNA testing that he knew to be incomplete. The omitted data contained test results showing that DNA of multiple men, none of whom were lacrosse players, was on a woman who said she was attacked at a March 2006 party thrown by Duke's lacrosse team.

Great. This jerk devastated the lives of three innocent kids and cost each of their families well into six figures for defending them. He deliberately lied and withheld exculpatory evidence. He cost the state of NC hundreds of thousands of dollars in court and administrative time. And for this, he spends a day in jail. Why, I thought those stiff penalties were reserved for Britney, Lindsay, and Nicole. Yes, he is disbarred. I hope to high heaven the families keep him in court for half a decade until he’s living under a freeway overpass.
It usually depends on the judge and the circumstances. The only time I personally witnessed it in a courtroom, it came to light the same day, and the judge gave the attorney a major public chewing out, but no fine or jail. The attorney did grovel appropriately. Within a few months, the attorney had moved out of town.
This sentence was, at best, 1/22,000 of what minimal justice requires.

Personally, I think Nifong should be facing criminal charges of perjury (charging instruments are usually sworn to) and obstructing justice (for bringing the charge and for trying to hide the exculpatory DNA info).
He should be sitting in a prison cell IMHO.
