ALLENTOWN, Pa. (AP) -- A federal judge on Thursday struck down the city of Hazleton's tough immigration law, which has been emulated by cities around the country. The Illegal Immigration Relief Act sought to impose fines on landlords who rent to illegal immigrants and deny business permits to companies that give them jobs. Another measure would have required tenants to register with City Hall and pay for a rental permit.
It was pushed by Hazleton's Republican mayor last summer after two illegal immigrants were charged in a fatal shooting.
Hispanic groups and illegal immigrants sued in federal court to overturn the measures, saying they usurp the federal government's exclusive power to regulate immigration, deprive residents of their constitutional rights to equal protection and due process, and violate state and federal housing law.
I’ll bet he was a Clinton or Carter appointee !!
>>Ill bet he was a Clinton or Carter appointee !!<<
I don’t know - I don’t like the idea of having to get a permit from the local government before I am allowed to live there - we’ve always had free movement around the country and we’ve already limited that more than I like.
It would be easier to try a tax revolt first. Stop funding their paychecks, and you’d see how fast our “”Representatives”” would perk up and pay attention to what WE want, for a change!
Ok, here is a little rundown of the activist judge 206 page opinion
the nature of the political system in the United States prohibits the city from enacting ordinances that disrupt a carefully drawn federal statutory scheme," Munley wrote in a 206-page opinion.
Then, he contradicts the "correctness" of his bs with the following...
"Even if federal law did not conflict with Hazleton's measures, the city could not enact an ordinance that violates rights the Constitution guarantees to every person in the United States, whether legal resident or not," he added.
Ok which is it? Is the "opinion" of the judge correct or not? Apparently even the judge is not firm in his "opinion." What a piece of traitorous trash.
And as for being part of the feds, perhaps he should listen to his boss...
According to Mr. T. Snow, White House Mouthpiece, "Let me lay down a general rule, which is: The president, because of federalism reasons, does not talk about state, local, county, municipality, Cub Scout, Girl Scout, or other resolutions," Snow said.
Ok, then the president, because of federalism reasons, does not talk about state, local, counties or municipalities kicking the illegals all the way back to me-hee-co.
The Federal Government should instruct all federal judges, because of federalism reasons, to not overturn state, local, counties or municipalities laws or ordinances in regards to actions taken at local levels to prevent infestation of their state, city or town by illegal aliens.
Those are rights reserved for the state and local, counties or municipalities, according to the quoted federalism reasons. So, seeing as how federal judges do overturn state, local, counties or municipalities laws and ordinances on a regular basis, exactly as this one has, I can only conclude that Mr. Snow, quite probably under direction from the President, and the President of the United States himself is lying, repeatedly lying and on this issue alone are in violation of the clear and unalterable precept of the very government they proclaimed they are executing...
>> the nature of the political system in the United States prohibits the city from enacting ordinances that disrupt a carefully drawn federal statutory scheme,” Munley wrote in a 206-page opinion.<<
So there is hope if they get a cleaner local law - we know there we don’t have to worry about conflicting with a carefully drawn Federal scheme. Depends on how you define scheme, I suppose...
Well, perhaps in a Freudian way the judge at least got one word right.
Fair freedom's glorious cause I've meanly quitted,How about Lord Bute's symbol?
For the sake of pelf;
But ah! the Devil has me outwitted,
And instead of stamping others, I've hang'd myself
Can we come up with one for Judge Munley? :-)
And don't forget...
I used to haul into Hazelton, it is full of illegals, so is Allentown, Easton, Bethlehem, um well pretty much anywhere east of the Susquehana River
Ping to self - count to ten, and read this again carefully when you aren’t so pissed off.
“... illegal immigrants sued in federal court to overturn the measures, saying they usurp the federal government’s exclusive power to regulate immigration, deprive residents of their constitutional rights to equal protection and due process...”
1.) “...they usurp the federal government’s exclusive power to regulate immigration...”
Really? The federal government enforces immigration law? Then why did this measure and the resultant legal action become necessary?
2.) Key phrases: “illegal immigrants;’ and “deprive residents of their constitutional rights...”
When did non-citizens, whom are in this country illegally, acquire “rights” under the United States Constitution? These “immigrants” are NOT US citizens, nor are they legal US “residents.”
It is a good thing they did not name the judge responsible for this treachery... else he might soon assume a horizontal posture at room temperature.
Do these scoundrels ever worry about their personal safety? Since 90 percent of the American public is beyond furious about this immigration conspiracy, I am awaiting news of the first assassination attempt — or success —on one of these traitors. The day must surely be coming.

Friend, as long as I am able to tell the truth, ride well, and shoot straight... I will never be powerless.
As long as I hold the 2nd Amendment in my steady hands... I will never be powerless.

If we have as much the balls to ACT, as we have the tempers to complain, then nothing will be finished... until we declare it is so.

“...It appears like the judges are making up the law as they go along.”
Should read as follows: “...It appears like the judges are MOCKING the law as they go along.”

“U.S. District Judge James Munley ruled that landlords, tenants and businesses that cater to Hispanics faced “irreparable harm” from the laws and issued a temporary restraining order blocking their enforcement.”
This is not following the law, this is judicial activism. How must it be that by discouraging ILLEGAL activities, there is a double effect of harming LEGAL activities?
This “judge” ought be disbarred, hog tied, publicly bull whipped, tarred and feathered, given a “blanket party,” and then thrown down a very deep well somewhere. Then again, maybe we would do better to serve justice by hanging him by his bullocks from a lamp post in front of his court house.

“There goes the Neighborhood folks! there goes the Republican Party too!”
There goes the Republic... the GOP has been MIA for a long time.
“Burning judges houses... [etc], to make them resign when democratic means are available would be legally terrorism and it would be morally and ethically wrong.”
“Democratic means”?
Do you consider what the US Congress just tried to get away with, nigh three weeks past, as being “democratic”?
The OWNERS of this country spoke, wrote, faxed and phoned LOUD and CLEAR their definitive opposition to this pig-headed administration’s “comprehensive” immigration “reform”... to wit: amnesty. Did our elected officials do the “democratic” thing and vote according to the concerns of the majority of their constituents? Hardly.
Our duly elected officials demonstrated well their utter contempt for “democratic means” and for American citizens.
These enemies of the US Constitution plainly demonstrated that the august document is no longer recognized to be in effect as a governing set of prohibitions on federal power.
Democratic means, indeed not, sir.

1. We still elect the President and our congress - that is indeed democratic means.
2. I will break ranks with anyone who urges violence against the government while we can still vote and elect the government - no matter how they may try to justify violence or rebellion.
3. We are in the middle of a war that is already straining the country - this is a particularly bad time to rebel against the government of the United States. I oppose such rebellion without reservation.
4. I hope and think that 99+% of the people on this site agree.
5. I find it a little hard to believe we are even debating this.
