Can murtha be prosecuted for making false alllegations?

Public officials cannot be prosecuted for actions within the scope of their duties.

Unfortunately slandering members of the United States Military Forces is within the scope of duty for liberal Congressmen.

Article III, Section 3, Paragraph 1, of the Constitution of the United States:
"Treason against the United States, shall consist only in levying War against them,
or, in adhering to their Enemies, giving them aid and comfort."

The "aid and comfort" prong of treason has been interpreted
by SCOTUSe as requiring proof of four elements:
1. an intent to betray the United States (which can be inferred from);
2. an overt act;
3. witnessed by two people; and
4. that provides aid and comfort to an enemy of the United States.

Haditha case continuing to fall apart ping. Don’t hold your breath waiting for mea culpas from the media and the anti-military Left, who have used this case to bolster their “we shouldn’t be in Iraq” arguments.

Thanks for the clarification. I am so used to secret info leaking out, I guess I am surprised when it doesn’t.

The difference between this secret and others is that active duty Marines held the information. They weren't paying attention to the media and the likes of Murtha.

It wasn't until the information was being glossed over, or suppressed entirely, at the hearings that they starting speaking out.
