Smuggler handed pass after delivering 2nd load
WND ^ | July 25, 2007 | Jerome R. Corsi

Posted on 07/25/2007 1:08:11 PM PDT by AuntB

The drug smuggler who was shot at by former U.S. Border Patrol agents Ignacio Ramos and Jose Compean and testified against them when they were convicted in the case was issued unconditional, unescorted access to the United States during a period that included his involvement in a second drug smuggling incident, according to U.S. Rep. Dana Rohrabacher, R.-Calif.

He has obtained – and provided WND with – copies of Department of Homeland Security border pass cards issued to Osvaldo Aldrete-Davila, the smuggler in the case, covering that period of time.

"It appears as though the U.S. Attorney's Office was so intent on getting Ramos and Compean that their judgment was totally clouded to the degree they aided and abetted a criminal who was at that point actively engaged and already involved with a drug cartel," Rohrabacher said in a statement from his office.

.......On March 4, 2005, the U.S. Consulate contacted U.S. attorney's office at the Department of Justice. The Mexican national involved was Aldrete-Davila and the Mexican Consulate's demand led to the indictment and conviction of Ramos and Compean.

Five additional border pass cards were issued to Davila subsequent to March 2005, the last one issued on Jan. 24, 2006, marked valid for "multiple entries" until March 31, 2006.

Yes, because he wasn't the "drug smuggler", he was the "mule".

Oh, so now a guy who brings drugs in illegally is not a smuggler? You have shown your true colors. Quisling lawyer.

From the evidence, it's pretty clear he wasn't.

What evidence? Are you the first person in history that can prove a negative?

Was the underlying crime depriving him of his civil rights under the color of authority?

No. The supposed "crime of violence" was expressly identified as the 3 assault charges brought against them--including Assault with Intent to Commit Murder.

The civil rights/color of authority charge was not brought until a later superceding indictment.

But make no mistake, the evidence is clear that Ramos and Compean shot at an unarmed fleeing suspect with Ramos hitting him in the back.

You almost have Sutton's words memorized! Two border patrol officers say he was armed. The drug smuggler says he wasn't. No way to know for sure, but I can see whose word you value.

According to the evidence at trial, OVD had his hands raised and was attempting to give himself ...

Yeah, right. He was surrendering with his white flag. Give me a break! There was no such evidence.

I would think that this information should have been made available to the defense at the time of trial. If it wasn’t, then it seems like this case will have to be reversed.

“My money is on R or C picking it up. They were pretty thorough with the rest so why not this one. With Compean testifying he collected and disposed of the other casings, I guess no need for Ramos to jump in that puddle as well. Enough mud on everyones spats by this juncture.”

At most R&C are guilty of straying off of the proper chain of evidence, even though there was higher ranking officers at the seen. That was brought up in trial. What was not aloud in trial & covered up was OVD’s free pass during the trial.

No, but I did read the trial transcripts front to back....

Hard to believe since all you do is reiterate the drug smuggler's mythical version and Johnny Sutton's rhetoric.

You don't know he wasn't armed.

From the evidence, it's pretty clear he wasn't.

Specifically, what "evidence" are you referring to.

Unfortunately, the statute in question treats it as a double crime.

No. It doesn't. Did you miss the part about "furtherance" of a crime?

Pres. Bush referred to the U.S. attorney responsible for the atrocity, Johnny Sutton,
as "a dear friend of mine" and called the framer a "fair guy" and "even-handed".

I remember hearing Bush say that while I was yelling at the radio.

At this rate, the Republicans will be lucky to get a 30% turn out for the sham election. I have virtually no faith in the governments ability to honestly handle policies. Now, illegal drug smugglers are given a pass to assist the feds to nail border guards.

This government at it’s offices, is way out of control, both democrat and republican.

Well, you can keep going after the thousands of “mules” while the Tony Montano’s of the world laugh at your ineffective ass.

According to your philosophy, the FBI should have indicted and prosecuted the accountant who gave up the goods on Al Capone...and let Capone walk.

Don’t be a tool, you only get screwed.

It makes perfect sense if you accept the premise that the White House is behind the prosecution of BP agents who try to do their job.

Isn't he a fictional character?

“Two border patrol officers say he was armed.”

Hmmm, that’s weird. Because I specifically remember Compean (maybe Ramos) when asked at trial if “today do you still believe OVD had a gun” he answered, “I don’t know”.

Are you putting words in his mouth? Apostate, heal thyself.

Shooting at an unarmed suspect is an underlying crime.

The only 'proof' that Aldrete was 'unarmed' is his own claim. Why is it that you, and Sutton, choose to take the word of a criminal, a drug smuggler, over two BP agents who had no blemish on their records?
