Under what rock have these guys been hiding? Obstetricians have been held responsible for less than "perfect babies" for over 30 yrs. Despite ample evidence that cerebral palsy is by and large the result of prenatal factors, the John Edwards' of the world continue to convince American juries to award tens of millions of dollars in damages for these outcomes. I laugh when I see politicians wondering why Healthcare costs are stratospheric, as I see doctors ordering tests, performing procedures, obtaining consults to make the medical record look good in the event of a lawsuit. Stop the insanity!

I wonder what the critics on this thread would do if they had two severely handicapped children who needed very expensive care to have some semblence of a life and they were were going or had already gone bankrupt trying to provide that care. That’s right, most of you would sue.

We’re holding doctors responsible to deliver reasonably accurate information about the medical conditions of our children.

There is no tort for wrongful birth in the US — so I am highly surprised that the Judge didn’t throw this out. One hopes that it will get overturned on appeal.

They know all this, they have two other sons with this condition, they know what causes it, and they have the brass to sue somebody because they just keep on keeping on? What ever happened to personal responsibility? And they cannot fall back on the old catholic no birth control wheeze if they were willing to abort. SOme justice system.

IMO, this is the legacy of the drug culture.
Use all that crap- damage you own system and create monsters.
THEN you sue the doctor and the hospital.
Funny, the population didn’t have near this high a percentage of troubled kids before the drug culture of the 60’s.
Someday the researchers are going to prove my theory.
