South Sound residents outraged over the abduction and slaying of Zina Linnik have raised two key questions about Terapon Adhahn, named by Tacoma police as the suspect in the girls death.
Adhahn was an immigrant. Why wasnt he deported after his 1990 conviction for incest? Because federal law didnt require it. Adhahn, 42, came to America in 1977. He became a legal permanent resident, but never filed for citizenship.
Under federal law, a single conviction for a crime of moral turpitude doesnt warrant deportation for a legal permanent resident, Lori Haley, a spokeswoman for Immigration and Customs Enforcement, said Friday.
One conviction wouldnt render him deportable, because he was a legal permanent resident more than five years, Haley said.
Haley added that immigration officials knew about Adhahns 1990 conviction at the time.
The same laws say a second conviction could have triggered deportation. Adhahn was convicted of intimidation with a weapon in 1992. The case was filed in Tacoma Municipal Court. Immigration officials didnt know about that conviction.
We werent aware of the 1992 conviction at the time, Haley said. That happened in Municipal Court, so we were unaware.
After his 1990 conviction, Adhahn had to register as a sex offender. How did he avoid community supervision, and why wasnt the public notified about him?
He didnt avoid supervision, and he registered regularly. But the same 1992 conviction overlooked by immigration officials went unnoticed locally, and Adhahn was considered a low-level offender.
After the 1990 conviction, he was classified as a Level 1 offender the category deemed least likely to re-offend. Counselors praised his efforts at rehabilitation, according to court records.
Such offenders are not the sort whose names and faces appear on lists and notification fliers sent to communities. Police typically reserve that process for Level 3 offenders the category deemed most likely to offend.
Pierce County prosecutors charged Adhahn this week with failure to register as a sex offender. However, court records show legal authorities took no notice of the alleged failure until this week, when Adhahn was already deemed a person of interest in Linniks disappearance.
Adhahns 15-year offender registration requirement theoretically ended in 2005, records state. However, his 1992 conviction should have restarted the offender registration clock. Instead of ending in 2005, his registration obligations were to have ended in September 2007, prosecutors wrote this week.
I think it is a form of torture to unleash them on the public.
Are legal permanent residents entitled to vote, too...?

"Low-level" means the authorities judged that he was not likely to re-offend. He was rated "Level 1", in a system today that has 4 levels -- although you only hear of Level I-III, the "Level IVs" are the ones "civilly committed" at the end of their prison sentence.
At the time he was rated the rating system was, I think, rather new and hadn't been "means-tested" and revised accordingly.
There are judicial studies that examine the probability of a re-offense, both sex-crime or other, based on a whole bunch of factors -- but almost all of these studies were done after this guy's release.
Oddly enough, in this state anyone can register (thanks, Motor Voter law.) It isn't a crime unless the person actually votes in an election that only US citizens are entitled to vote in.

Recently an angry woman, fed up with the voting fraud of King County (Seattle), registered her dog to vote with his paw print. The Auditor’s Office called to confirm the signature and she told them it was a dog. They sent a letter asking for confirmation of the signature. So the lady sent in another paw print.
When the ballot came addressed to her canine she wrote VOID across the top and asked for it to be removed from the voter’s rolls. Ballots came for 3 elections!
Now the woman is being prosecuted for voter fraud (even though her pup never cast a ballot) and King County says that THEY are proud of the good job their office is doing (after all, it took only 3 elections to remove her DOG from the voters rolls.)
BTW, our winning Republican gubanatorial candidate then “lost” after two hand recounts of the election... New ballots were found at night, in empty machines, ballots were “enhanced”, etc by King County. Dino Rossi “lost” by 312 votes.

It works real well in criminalizing honest men for urinating behind a dumpster or snapping a towel in the locker room.
I don’t beleive they have released the details yet Calpernia. But the relative he accosted (plead down) was 16 and reported as violently raped. I sent this article to O’Reilly and see that they did cover it on air.

Police have detained a 42-year-old, level one sex offender, Terapon Adhahn, and are calling him a person-of-interest. Detectives searched a Parkland, Wash. home on July 9, 2007 and seized a safe, a box of black plastic sheeting, girl's undergarments, and over 40 other items.

The undergarments are a good indication that this child died while being sexually assaulted. Mr. Adhahn may be the first up for the federal death penalty.
