If the Democrats win the White House in 2008 and hold on to, or expand, their senatorial majority, the Democratic President will almost certainly get to replace at least two and quite possibly three Justices during her first term: Stevens, Ginsburg and Souter. Justice Kennedy and the conservative quartet are unlikely to retire voluntarily under a Democratic President.
Tom Goldstein of SCOTUS Blog has made a study of the possible Democratic short-list. His ultimate prediction is "Kim Wardlaw (2009, for Souter), Deval Patrick (2010, for Stevens), and Elena Kagan (2011, for Ginsburg)." A more detailed list and explanation is available on SCOTUS Blog.
It's a timely reminder for conservatives that ultimate victory in the form of a conservative court-majority may be close but can as easily be lost for another generation.
If the GOP manages to retain the White House in 2008, the Republican president is probably going to be in a position to finally achieve the conservative court majority that should have been obtained as long back as 1991. Elections really do matter

If the DemocRATS win the White House, the first person they will seek to appoint will be (IMHO) Sonya Santomier, who is currently on the U.S. 2nd. Circuit Court of Appeals. She has in the past endorsed the “living breathing” Constitution (it can be twisted to impose social policies on an unwilling public).
New York Freepers may be able to tell us more about her.
“going to be in a position to finally achieve the conservative court majority that should have been obtained as long back as 1991”
Even if the ‘pubs regain the House and Senate and keep the White House, 40 treasonous stalinists, aka dims, in the Senate can block anything. Too many Rinos in the count.
The Senate RINO’s have been pretty good about judges. Arlen Specter is set to fight the Democrats on their latest obstruction of Federal judges.
If the Constitution is “living and breathing” then logic would dictate that it can also DIE.
The “gang of 14” led by McStain, has made me question whether there is enuff spine in the ‘pubs anymore.
Democrats would probably put Muslims on the Supreme Court.
Very true. More proof that the GOP must hold the White House next year. This election is perhaps the most important in our lifetimes.
Call conservatives pro-Constitution-life.
Deval Patrick? One of the most corrupt elected officials in the nation? Unbelievable.

That would be "Coupe" Deval Patrick.
Yeah, that's what we need on the SCOTUS bench.
My respect and regard for the fear tactic of using SCOTUS nominees to keep conservatives on the reservation is tempered by the fact that 7 of the current 9 “justices” were appointed by Republican Presidents.
The judiciary is one of the big reasons we can not let Hillary be elected president in 08.
Amnesty for illegal immigrants, bigger government, more taxes, more regulations, more “9/11’s”, and more “red tape” are some of many other reasons not to have either Hillary Clinton or any other Democrat become POTUS ever, especially if both Houses of Congress are also still controlled by the Democrats!
This is why it’s so important that a Republican win. We are on the cusp of eliminating Roe, eliminating the expansion of eminent domain, and ensuring our domestic safety will not be hamstrung by the ACLU.
It’s now or never.
True, but look at from a time perspective. The most dissapointing judges from the GOP were appointed years ago. As time has gone forward, Republicans have done a more effective job of screening and choosing justices. Mistakes like Harry Blackman and John Paul Stevens are not likely to happen now.
It's true that being nominated by a Republican is no guarantee that a candidate is worthy of his/her robes but you've gotta admit that being nominated by a RAT is a guarantee that the candidate is a piece of excrement
Well, you probably have more confidence in the current crop than I do.
Wow. There’s a bumper sticker for ya...”we’re better than excrement!”
