If the recent 5-4 decisions on school affirmative action, McCain-Feingold Bill in Wisconsin and others show, it is this -- 2008 will be a critical election year. With Several justices nearing their late 70's and one over 80, there will be an opportunity for the next president to select at least one or maybe two justices whose vote will sway the direction of this country towards becoming more liberal or more conservative.
This video reminds us of what the stakes are.
I think one will leave before the 08 elections (likely Stevens).
If that happens, how long will it take to unleash the hordes on the nominee?
The fattest one (I forgot if it’s Breyer or Kennedy, but he is a lib) couldn’t last much longer. Everyone send candy and cookies!
Only Ginsburg (74) would be nearing the late 70s in a couple of years. Scalia is 71 and Kennedy will be 71 next month. Everyone else (save Stevens) is under 70 (Breyer 68, Souter 67) or under 60 (Thomas 59, Alito 57, Roberts 52).
Stevens will almost certainly be replaced by either this administration or the next. Ginsburg likely will be replaced by the next.
Doesn’t matter so much who the President is as it does who controls the Senate post the 2008 election cycle.
I think it unlikely that anyone would step down at a time like this unless they seriously could not go on.
I think the only vacancy that could occur would be from the death of Justice from illness or accident.
Divided Gov't - I think it is exactly when one of these guys would like to step down. Additionally there very well are health concerns for two of the justices.
I disagree. The President has the initiative and is the only one who can nominate these people. All the Senate can do is say "no." The Republicans controlled the Senate when Clinton nominated Ginsburg, and they rolled over.
Elect Fred. Then, between Bush's remaining 1 1/2 years and Fred's 8, Stevens and Ginsburg will be replaced with conservatives. Maybe Breyer will even step down (well, I can dream, can't I?).

They only nominate those they believe can get confirmed. Without control of the Senate, we won’t see another Roberts or Alito, let alone a Scalia.

There is not a chance that any nominee we would like would get through the Senate. Bush’s only choice is to recess appoint someone for the remaining term and let the next President get the pick. I don’t think he’d too that, though—too confrontational.
The man is 87. Life insurance companies peg a male at his age with about a 25% chance of death before they turn 88.
Even if that is true, a 'moderate' like Kennedy is a huge improvement from a leftwinged nut.
To borrow a phrase from the 'evil party', "it's for the children".
