Birthright Citizenship Act of 2007 - Amends the Immigration and Nationality Act to consider a person born in the United States "subject to the jurisdiction" of the United States for citizenship at birth purposes if the person is born in the United States of parents, one of whom is: (1) a U.S. citizen or national; (2) a lawful permanent resident alien whose residence is in the United States; or (3) an alien performing active service in the armed forces.

I don't fully 'feel', nor understand the language on this. I get number 2, but not one. Either way, an amendment that stops this travesty cannot happen soon enough for me.

I am so happy to see that there are two politicians that are pushing for this change. It gives me hope. As someone mentioned phone calls and faxes on this should have an impact to show support about how serious we are about this change as this may be one of the most impactful and political changes we have made to the constitution since Roe v Wade.

The Supreme Court’s ruling in Plyler v. Doe[3] stated that illegal immigrants are “within the jurisdiction” of the states in which they reside, and added in a footnote that “no plausible distinction with respect to Fourteenth Amendment ‘jurisdiction’ can be drawn between resident aliens whose entry into the United States was lawful, and resident aliens whose entry was unlawful.” Some legislators, reacting to illegal immigration, have proposed that this be changed, either through legislation or a constitutional amendment. If the Supreme Court adheres to current interpretations of the Fourteenth Amendment, then it may be that only an amendment would be effective to bar the children of illegal immigrants from citizenship, although Plyler did not explicitly address the question of children born in the United States to illegal aliens or other non-citizens; the children dealt with in Plyler were born outside the U.S.

note the the term “current interpretations”...that could change

That’s right: the 13th, 14th and 15th Amendments were passed shortly after the Civil War/War Between the States.
Let’s see now, why was that—why did the Congress do that: pass 3 amendments, bing-badda-boom . . . ?

Oh yeah! The 14th Amend., particularly, was passed so that approx. 150 years later Mexican nationals could rush across the border and drop `anchor-ninos’ in American hospitals!

That’s exactly what the `con-law scholars’ would have you believe.

problem with the senate is that 6 years does give them a certain de facto immunity

in this case if they give blanket amensty, the new plurality will keep them in office...or elect a Dem...arguably worse even

I live it Texas and have been in a public hospital and seen pregnant what appeared to be illegal alien women lined in a maternity ward all about to give birth. I understand that this is a problem and that it works to attract illegal aliens to the nation.

However, I also understand that the bill will not pass and if it did pass, would never ever not matter what would be signed by President Bush. Finally, if we were able to hypnotize President Bush and ordered him to sign the Act it would not stand up to the Supreme Court.

You would have to Amend the Constitution.

I'm an old fashioned conservative. I applaud foreigners who travel to the USA to spend money. I don't get your complaint.

I’m not willing to say or believe the demonrats are going to be given all the keys to the nation that easily. A lot more people are awake. If the proper 30 second ads hit, no telling what could happen. We could maybe get our county back. Wouldn’t that be great......

the Supreme Court would certainly hold it unconstitutional under the 14th Amendment.

They certainly don't have to. The could look at the intent of that part of the XIVth Amend and note the total lack of 150 year old mothers giving birth.

No, you wouldn’t. You keep repeating false information even though I gave you the correct information - from the actual record of congress!

Get it through your head- no new amendment is needed. The proposed law doesn’t go against the 14th amendment- it clarifies it.

You are wrong. Stop trying to act like you’re right.

Think positive!!! and let's do the footwork.

With an attitude like that the U.S. would not even exist.

Look at how hard the Roe v Wade people worked to get an amendment (or whatever the legal term is for its existence) that allows people to kill people. Unfortunately with results. We can work hard as patriots to secure our citizenship rights and who we give those rights to. IT IS OUR COUNTRY! WE NEED TO CLAIM IT AND FIGHT FOR IT.
