To increase public safety by permitting the Attorney General to deny the transfer of firearms or the issuance of firearms and explosives licenses to known or suspected dangerous terrorists.

IN THE SENATE OF THE UNITED STATES

April 26, 2007

Mr. LAUTENBERG introduced the following bill; which was read twice and referred to the Committee on the Judiciary

A BILL

To increase public safety by permitting the Attorney General to deny the transfer of firearms or the issuance of firearms and explosives licenses to known or suspected dangerous terrorists.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Denying Firearms and Explosives to Dangerous Terrorists Act of 2007'.

SEC. 2. GRANTING THE ATTORNEY GENERAL THE AUTHORITY TO DENY THE SALE, DELIVERY, OR TRANSFER OF A FIREARM OR THE ISSUANCE OF A FIREARMS OR EXPLOSIVES LICENSE OR PERMIT TO DANGEROUS TERRORISTS.

(a) Standard for Exercising Attorney General Discretion Regarding Transferring Firearms or Issuing Firearms Permits to Dangerous Terrorists- Chapter 44 of title 18, United States Code, is amended--

(1) by inserting after section 922 the following:

`Sec. 922A. Attorney General's discretion to deny transfer of a firearm

`The Attorney General may deny the transfer of a firearm under section 922(t)(1)(B)(ii) of this title if the Attorney General--

`(1) determines that the transferee is known (or appropriately suspected) to be or have been engaged in conduct constituting, in preparation for, in aid of, or related to terrorism, or providing material support or resources for terrorism; and

`(2) has a reasonable belief that the prospective transferee may use a firearm in connection with terrorism.

`Sec. 922B. Attorney General's discretion regarding applicants for firearm permits which would qualify for the exemption provided under section 922(t)(3)

`The Attorney General may determine that--

`(1) an applicant for a firearm permit which would qualify for an exemption under section 922(t) is known (or appropriately suspected) to be or have been engaged in conduct constituting, in preparation for, in aid of, or related to terrorism, or providing material support or resources for terrorism; and

`(2) the Attorney General has a reasonable belief that the applicant may use a firearm in connection with terrorism.';

(2) in section 921(a), by adding at the end the following:

`(36) The term `terrorism' includes international terrorism and domestic terrorism, as those terms are defined in section 2331 of this title.

`(37) The term `material support or resources' has the same meaning as in section 2339A of this title.

`(38) The term `responsible person' means an individual who has the power, directly or indirectly, to direct or cause the direction of the management and policies of the applicant or licensee pertaining to firearms.'; and

(3) in the table of sections, by inserting after the item relating to section 922 the following:

The entire bill is too long to post, I posted just the first few sections of it, but the entire bill can be read at the linked website.

The bill would allow the AG, not just Gonzales but any future AG mind you, to deny the right of ANY American to buy, own, or possess a firearm or ammunition if the AG simply SUSPECTS that he or she MAY be a terrorist or have some connection to a terroist organization. The bill would allow the A.G.'s office to deny that right even though the person being denied has not been arrested or convicted of any crime related to terrorist activity, but is merely SUSPECTED of being a terrorist or of giving aid to terrorists.

You may not think that the current administration would use that bill, if it becomes law, to deny 2nd Amendment rights to law abiding gun owners and you may be right. But just imagine what a future president Hillary and her Attorney General Chuck Schumer would use it for. If you value your guns or your right to own a gun, call or write your Congresscritter and your Senators and tell them what you think about this bill.

That Lautenburg is for it, is all I really need to hear. We may be nearing the time when we should start storing our weapons in multiple geographic locations.

Well, it is the entire Washington government that has become dysfunctional and more and more socialist. The gun-grabbing anti-Constitutional crowd can and should be voted out and if that means replacing every one of these pinko elitists, then so be it.

Administrations don't have the discretion to determine who has constitutional rights and who does not.

That is a characteristic of a totalitarian government, not a constitutional democracy.

Such a law obviously violates the constitution, and Gonzales should be removed from office for supporting it.

If I were an anti-gun AG, I’d try to apply this to entire classes of people, not just individuals.

Let’s say that first, I declare an extremist right-wing pro gun rights organization to be under suspicion of promoting domestic terrorism, based on militaristic public statements of the organizations’ leaders*. Then, each member or former member can be blocked in NICS.

It would be challenged in the courts, but that would take time.

Recall that the Left openly frets about the No Fly List, where people can find themselves banned from otherwise peaceful and lawful travel because some nameless and faceless government official put their name on the list. As a person who cherishes the Constitution, I agree that it is tyranny to allow such as list to exist without the ability to have judicial review or the ability to petition for a fair hearing.

But the Left never “cares” about anything without it being part of the support structure for their broader hate-liberty, hate-freedom, hate-prosperity, hate-individual rights, hate-moral values, hate-America agenda.

It should come as no surprise then, that the Left can support this new Lautenburg bill, and still tell us why the No Fly List is so contrary to the “penumbra and emanations “ of rights and enumerated powers in the Constitution and Bill of Rights, especially in the Right that Shall Not Be Infringed.

Good point. A future Democrat administration will be sure to apply the Terrorist label to U.S. militia groups with more enthusiasm than the fight against Al Qaeda. After all, hating Al Qaeda is racist.

And they openly want to put No Fly List people into NICS. The Gonzales bill does that.

Which would be a good way for someone to find out if they are on a secret list, go buy a Kahr and see if NICS lets you.

Who defines what or whom the extremely vauge word “terrorist” applies to, and what, or whom it doesn’t?

I really don’t know what to think about this “WOT” anymore.

Typical mental midget lawyer who only parrots what he is told by professors and never thinks about it.

Gonzalez was ALWAYS a bad name on the short list.
