A sort of corollary question is, if Equal Protection doesn’t apply, what stops citizens from using illegals as proxy shields?

If your IRS bill is to big, claim the income was to your gardener Jose and he now has immunity. Foist a workplace violation on an illegal, have him apply for a zvisa, and voila, problem gone.

And anyone who claims that the so-called ‘triggers’ in the bill see to it that border security comes first needs to get a reality check.
Too true and what with the phrase "as funding is made available", or other such words to that effect, all that needs to happen is a declaration that funds for some part of the triggers aren't available and an allowance is made for the other things to be implemented anyway.
The Secure Fence Act, passed last year...
There is so much overlap in the bill that it staggers the imagination. Many of the things proposed in this bill already have stand alone bills waiting for debate, are already covered by existing laws, or already exist.
It is an affront to Americans to handle this matter in the manner in which it is being done.

(I believe the supporters of this bill took careful note of Bill Clinton’s promise not to raise taxes, which was conveniently explained away after he ‘discovered’ the magnitude of the deficit.
Too true, and I believe the POTUS took careful note of his Dad's failure to gain a second term with his "no new taxes" pledge and waited to move on this in his second term so that his "this isn't amnesty" wouldn't be seen in the same vein.

The point was that for some, the draft bill could have been made into something that they could support.

You’ve indicated that you dislike it to the point that nothing could have been used in good legislation. That’s fine. I have said several times on the Thread that fighting the good fight but doing so honorably is the way through it, but it’s not realistic to have an enforcement only bill.

Moose4 had presented an option to separate enforcement and tell Congress that they’d have to show the voters first, which is one way past this hurdle. It does risk what happens in the next Congress and with the next President.

It’s probably not going to come up again in this Congress. I don’t think that Sen Kennedy will want to make concessions for more Republican support.

He had said before that he doesn’t believe it’s realistic to arrest and deport 12 million people. You don’t agree with him, but that’s the way it is.

The point is that no one wanted the prior bill in part because Ted Kennedy would support it. Fine, but that was a better chance to get what you wanted than we had.

The good news if you want to see it that way is that the chances of it making it in this Congress are slim. It’s possible, but not likely.

The risk is what would happen in the next Congress and the next President.

A script would be a harder time to work. Some financial systems are on newer technology, so a Unix script could work. Others are on a variety of older technologies and there are some that have several different applications for the same institution. I am not trying to be snarky, I am telling you what I know.

I don’t disagree with that, but I don’t think it’s realistic to expect enforcement unless there’s a carrot. Moose4 had a good idea and that was to say, you want an immigration bill? Alright, but before we talk about that we need you to prove to us that you will enforce the laws because we aren’t happy with the results.
