When you pay a fine for stealing, you don't get to keep what you stole. You must also pay restitution. The fact that they benefit in the end from their lawbreaking makes this a fee, rather than a fine.

I should have read your post first! You beat me too it.

I don't how people can be missing the issue of restitution. Also, getting fined for a crime does not make a person immune to prosecution if the person commits the crime again.

The text in question...

(k) PERIOD OF AUTHORIZED ADMISSION.--

(1) INITIAL PERIOD.--The initial period of authorized admission as a Z nonimmigrant shall be four years.
(2) EXTENSIONS.--
(A) IN GENERAL.--Z nonimmigrant may seek an indefinite number of four-year extensions of the initial period of authorized admission.
(B) REQUIREMENTS.--In order to be eligible for an extension of the initial or any subsequent period of authorized admission under this paragraph, an alien must satisfy the following requirements:
(i) ELIGIBILITY.--The alien must demonstrate continuing eligibility for nonimmigrant status;
(ii) ENGLISH LANGUAGE AND CIVICS.--
(I) REQUIREMENT AT FIRST RENEWAL.--At or before the time of application for the first extension of nonimmigrant status, an alien who is 18 years of age or older must demonstrate an attempt to gain an understanding of the English language and knowledge of United States civics by taking the naturalization test described in sections 312(a)(1) and (2) by demonstrating enrollment in or placement on a waiting list for English classes.
(II) REQUIREMENT AT SECOND RENEWAL.--At or before the time of application for the second extension of Z nonimmigrant status, an alien who is 18 years of age or older must pass the naturalization test described in sections 312(a)(1) and (2). The alien may make up to three attempts to demonstrate such understanding and knowledge but must satisfy this requirement prior to the expiration of the second extension of Z nonimmigrant status.

So as I'm reading it they have up to the end of their second extension, just short of eight years, to pass the test.
If it passes as amended.

I am not approaching this as a religious text, although you are free to do so.

So come up with something that will work and win. Why not reform welfare and health care so that the illegal immigration problem becomes smaller?


How about starting by doing what they said they would do in 1986? Control the border, enforce the law. Why is that easier after granting amnesty?

And yes it is amnesty. There are no required $9000 fines to get the Z visa, only to get citizenship. They are immediately legal.

Besides, you and I will be paying that $9000 for them via tax breaks - getting "refunds" in excess of taxes paid and more social programs.

It's really quite ironic when you think about it.

It is very likely that this law would amended in less than 8 years as there would be a huge pool of that would be in violation.

I have no doubt that this amnesty law will continue to be watered down year after by congress and the enforcement provisions will be ignored by the executive branch.

But he didn't [Bush did not get a friendly ear], because the self-designated "base" was unwilling to discuss or permit discussion of alternatives to the unrealistic, draconian things they were advocating.

The unwillingness of the base to listen, and/or so-called hate of the base, did not come out of nowhere.

If Bush, or Congress, had made serious efforts and noises to shut down the border to NEW illegals, before proposing their cockamamie plan, we would have something to talk about.

If Bush thinks that a couple of ICE raids, 6 years into his term are going to fool anyone, he can think again.

1st, 800 miles of double layer actual fence. None of the virtual fencing crapola. If they can get it done in 18 months then President Bush has an excellent chance of getting the bill.

There’s no question that some compromises shouldn’t be made, but it doesn’t mean that none should either.

Providing de facto permanent residence to illegal aliens who are uneducated, unskilled, do not speak English, and are literally peasants in their own country - while even highly qualified law-abiding applicants wait patiently for years in their home countries - is immoral and unethical.

Is that your "compromise"?

President Bush promised a temporary program in writing and in his Jan 2004 speech, and has touted a "temporary" program until very recently.

Obviously he was lying to his consituents and the American public.

Is that the "compromise" he's made?

Here’s what we do know. It took a thousand agents to round up 1,000 illegal aliens. So by your argument, to take care of the issue right now, we need 12 million agents.

They need to go to work more than one day a decade.

Not a problem. Many of the criminals paid their Coyotes much more than that just to get here.

I say round them up and deport them. Yes... It will devastate the Mexican economy but then that is their problem now isn't it?
Then... we must get rid of our welfare system. Once we do that the huge vacuum sound we will hear that is caused by the exiting criminals can be filled by those that have been living high on the hog at the taxpayer's expense.
And let's not forget that we must enforce the immigration laws we already have.

Otherwise we are going to end up in a civil war.

I used the " Forward " command at the bottom of the page and my browser's " Find " function for the word "English".

Note that virtually everything that happened in the Senate was an amendment to 1150, not to 1348.
There are 47 listed amendments for S.AMDT.1150.
There are 350 listed amendments for S.1348.

That’s what stinks about this whole amnesty thing. Just think, if he’d broken the law, walked across the southern border, he’d probably be getting his green card sooner and without all the mess of lawyers and dealing with the horrible legal immigration system. Reward the criminals, punish those who obey the laws. It seems to be the new American way, he should fit in quite well.

Strawman argument.

How many agents does it take to serve a Hormel/Tyson/Libby/Cargill plant manager with a federal cease and desist order, a federal felony warrant, and a federal search warrant. Followed by two private lawyers representing the plaintiffs of a public class action RICO lawsuit against that plant?

I count 10 people maximum, and that plant will be absent of illegal aliens within 30 minutes.

They'd have to prove they're working and have no significant criminal record. They'd have to learn English and American civics. And, if they want legal permanent residence, they'd have to return to their home country to apply for it there. Getting a green card would take at least eight years, citizenship at least 13.

Some amnesty.

In a perfect world, it might be reasonable to say that everyone here illegally should be deported. Law breaking, obviously, cannot be ignored. But if that were possible at all - which is very dubious - the cost would run far into the billions.

As the adage says: "The Devil is in the details!"

As has been pointed out REPEATEDLY on this board and elsewhere, when you read the actual language contained in the legislation, there is an "out", a loophole, or a provision for a "waiver", etc. at the "discretion" of some diligent government official for every single one of those portentously enumerated fines, fees, or performance requirements mentioned above.

Those penalties and requirements will never be enforced. The President knows it, the Congress knows it, the MSM knows it, and most importantly, the illegal aliens know it.

The bottom line is that our political class, from the President on down, have forfeited any presumption of trust and credibility. What they SAY is irrelevant. It's only what they actually DO that should interest us.

The only way they can regain any credibility and trust is to drop the deception and BS and secure the border first. After they have demonstrated that they can do that, we can talk about the rest.

Ok--just watched Tony's segment. He said that while enforcement for the 1986 bill was a "joke," THIS time, it would be different. Tony sounded sincere and I wish I could believe him, but but the government simply does not have any credibility on this issue.

Why would it be different this time?

No one can possibly believe that unless the law is defended BEFORE any bills are passed. Since there is not the smallest sign that that is being done, and since passage of this bill would almost certainly guarantee a Democrat victory next year, such an assurance is merely laughable.

Bush won't be around to enforce it. Moreover, he has shown not the smallest interest in enforcing the immigration laws. Instead he has given us a record of sending border patrol agents to jail for trying to enforce the laws against drug dealers and criminals caught in the act.

If this bill is passed, and as a result the Republican party is destroyed, then will hillary be more eager to enforce it than Bush has been? I think not.

Prayers for Tony Snow and his family, but I am sorry he has agreed to defend the indefensible.

Although I have little hope that anyone in the administration seems to be taking note, I will continue to “vote” my displeasure (a mild word indeed) via email of how the administration is choosing to push an intellectually and politically bankrupt approach to immigration “reform”.

The approach is also morally bankrupt in that it lies about the realities of the illegal immigration situation, lies about the abject failures of the administration and Congress to address it since 9/11, and lies about the true nature of the objections being raised by millions of Americans. We are not nativist yahoos or racist rednecks, nor are we ignorant sheep who would “support the bill if we simply knew the details” (cf. Mr. Snow).

No, we are people who are opposed PRECISELY because we know the details, and we are deeply offended at the mischaracterizations of the bill’s opponents made by the administration.

The administration is still whistling in the dark, seemingly willfully ignorant of the lasting, indeed catastrophic, damage being done to its credibility among the American people.
