Recent attacks on "activist judges" by legislative bodies could be putting the concept of an independent judiciary at risk, retired Associate Supreme Court Justice Sandra Day O'Connor said Friday. "These are appalling times," O'Connor told a crowd of 700 during a moderated discussion about her career at the University of Tulsa. "There is so much rancor and dislike going on." O'Connor asked the crowd if it heard of the attacks on so-called "godless, secular humanist, activist judges," and cited cases in several states where people attempted to introduce ballot measures that would toss judges in jail for making the wrong decisions or shorten their terms on the bench... She said an independent judiciary enables judges to resolve cases fairly, "and let the chips fall where they may," even if the legislative branch isn't happy with the outcome... O'Connor also discussed her recent role as a member of the Iraq Study Group, a bipartisan commission that met to assess the current and prospective situation in Iraq and the surrounding region. The report called for a gradual troop pullout and more aggressive regional diplomacy.

There would be little rancor if judges would stick to being judges. But they want to legislate. Thus, they are attacked like any other politician.

Judges are first lawyers. Then, unlike most lawyers who love money, judges decide they would rather have power than cash. Thus they are more dangerous than the average lawyer. Watch them, criticize them, and when possible remove them when they get out of line.

Judicial accountability is imperative. Our justice system is inoperable without it.

Bad judges should be sentenced to stiff criminal penalties—not just bounced off the bench—when clear malfeasance, gross derelict, obstruction of justice, or provable bias can be established.

Other public servants are held to that standard, it’s beyond high time judges are too.

In other words she believes that judges are not to administer and interpret the law, but to make the law (activist judges) and no doubt to enforce (judicial order) in addition to their Constitutional duties. I guess she doesn’t believe in a 3 branch government, Judicial, Legislative and Executive. Kind of makes one wonder why the GOP let Ginsberg take her seat which should have been kicked out, or BORKED.
