In a court filing today, Patrick Fitzgerald provides a summary of Valerie Plame Wilson's status with the CIA's Counterproliferation Division at the time she was outed to the press by members of the Bush administration. Guess what? She was covert:
While assigned to CPD, Ms. Wilson engaged in temporary duty (TDY) travel overseas on official business. She traveled at least seven times to more than ten countries. When traveling overseas, Ms. Wilson always traveled under a cover identity — sometimes in true name and sometimes in alias — but always using cover — whether official or non-official cover (NOC) — with no ostensible relationship to the CIA.At the time of the initial unauthorized disclosure in the media of Ms. Wilson's employment relationship with the CIA on 14 July 2003, Ms. Wilson was a covert employee for whom the CIA was taking affirmative measures to conceal her intelligence relationship to the United States.
...she had been working under cover outside the U.S. quite extensively during the previous five years, which means that Plame almost certainly qualified as "covert" under the specific definitions outlined in IIPA. Nonetheless, for some reason Fitzgerald decided not to bring outing charges against anyone. This suggests that Mark Kleiman has been right all along: Fitzgerald's decision had nothing to do with technical aspects of IIPA, but rather with its scienter requirements.
That is, the leakers had to know that leaking Plame's name could be damaging, and Fitzgerald didn't think he had the evidence to make that case. That might have been especially true since the leaks seem to have been authorized at very high levels, something the leakers could have used in their defense at trial.

Friends of Scooter Libby Fear He'll Be Sent Immediately to Jail

When Lewis "Scooter" Libby is sentenced next month for his involvement in the Valerie Plame-CIA spy scandal, friends and legal allies fear that he will immediately be shipped to jail.
"I think that he will get some jail time and probably be sent away that day," said a member of the Libby Legal Defense Fund.
Libby's supporters plan to make the case again that the prosecution was politically motivated, spun out of control, and ended up nailing someone who wasn't even the leaker of Plame's name in the case. Special Prosecutor Patrick Fitzgerald, however, has already dismissed those claims and added that Libby has shown no remorse for his acts. Fitzgerald is expected to push for a sentence of up to three years in prison for obstruction.

Tha fact remains that Scooter Libby was a scapegoat for Fitzgerald so he could get some kinfd of conviction and Fitzgerald wasted millions and should be held responsible.
It was all political BS.
This is just the Vast Leftwing Conspiracy cleaning up a loose-end so that the reporters can right their books & have a ‘happy ending’. Nothing more. Move along.

I just don't buy the Langley to under cover to Langley to undercover part unless the law is written vaguely enough so that any CIA employee seeking to travel without waiving a flag is covered.

Different rules than my organization. We are told to keep a low profile when traveling abroad.
It strains believability that she did not support and encourage her husband in this incredible breach of protocol, and it is inconceivable that a faithful CIA agent would sit by silently while her lying husband embarrassed her, the CIA and her country to the Nth degree.
Valerie Planme is a politician first, CIA agent second. She and her husband undermined US foreign policy in the middle of a war. Why would anyone think her status would be sacrosanct under these circumstances?
No. In CIA parlance, once "covert", always "covert".
But "covert" was never part of the argument. Instead, the argument concerned "protected" -- as in "a protected identity" under the terms of the Espionage Identities Protection Act.
Plame's was clearly not a "protected" identity. And still isn't.
