Dear Mr Robinson:

We are writing on behalf of our client, the Democratic National Committee (DNC).

A post by “coffee260” on FreeRepublic.com today states that this morning, on the Quinn & Rose show on XM, co-host Quin stated that the DNC chairman, Gov. Howard Dean had called Gov Kathleen Sebelius (D-Kans) “around 5:00am on morning after a tornado destroyed the town of Greensburg, Kansas and discussed with here what to say about the tornado and how to blame the war in Iraq and the Bush administration on a slow response to the aftermath.”

The statement was made by Mr Quinn, repeated on FreeRepublic, is demonstrably, unequivocally and absolutely false. Gov Dean had no such conversation with Gov Sebelius, ever.

No effort was made by FreeRepublic to contact anyone at the DNC for comment or to check the accuracy of these statements before they were published. FreeRepublic not only repeated this statement, but further stressed that Quinn’s “source” was extremely reliable and in a position that would give him direct knowledge of these revelations.

The statements quoted above are false and defamatory, are libelous and slanderous and clearly threaten to interfere with the DNC’s operations and ability to solicit support and raise funds by predjuding the organization in the eyes of the Democratic Party supporters and the public. For these reasons, we demand that FreeRepublic immediately cease and desist from Further dissemination of the above quoted statements or any statements similar in substance and immediately post a retraction of these statements in a location on its web pages at least as prominent as that on which the original story appeared.

Please let us know by noon, May 11, 2007, whether you intend to comply with these requests.

Apparantly the DU website has caved in.

Democratic Underground is currently down for maintenance. We apologize for the inconvenience and we are working to bring the site back up as quickly as possible. This maintenance is necessary to help us resolve the continuining stability issues we've been working on.

Let's see: Dean can repeat lies about 9-11 being an inside job, but no one else on the planet can repeat 'so called' lies about Dean giving underhanded, slime ball political advice.

I've redacted your original post so that the DNC Stalinists don't take me to task for repeating such charges.

And yeah, you have that right, there is a double standard at play.

Some have surmized that the source is a “Brownback for President” aide. The Senators own staff would know enough not to leak this story because it really makes Brownback look bad.

Hopefully, if this is true the aide will come forward.

Here’s the basic issue, over and above the ‘public figure’ limitation on slander suits, the individual involved has to prove they’ve been damaged in some way. Given the history of Dean and the DNC, how could they possibly prove their reputation for veracity has been impinged? And, given the history and tendencies of the DNC, how could being claimed to be the purveyor of untruths possibly harm Dean’s occupational prospects with them?

No damage, no lawsuit. This is a SLAPP action, pure and simple.

The weird thing about this is the letter to XM radio. Why would any self-respecting (maybe that doesn't apply here) law firm send a C&D to somebody, based on a post on a website?

If Howard Dean was listening to Q&R at 5:00 and heard the thing, I would understand.

But Howard Dean saw on a website that somebody else heard it?

How flimsy can you get?

Googling did turn up some information on contributions from the firm's lawyers to assorted Democrat candidates, no surprise there. It also turned up the information that name partner Jeffrey Sandler is the lawyer for MoveOn.org From that alone, it is a fair conclusion that this firm's interest in objective truth is nil, zip, nada, zilch.

Then that must mean that this is a part of the overall Media Matters monitoring of conservative outlets. This C&D is part of the same strategy to marginalize Limbaugh, Hannity, Savage, O'Reilly, and now Free Republic before the 2008 election gets too hot.

Just thinking out loud here.

Assuming this did transpire as Quinn described it, perhaps the DNC (via ABC) knows that Brownback’s name is on the DC Madam’s list or has some other dirt on him that they’re threatening him with.
