Pardon Me? A Congressional Pardon [Duncan Hunter]
NY Times ^ | May 7, 2007 | By Sarah Wheaton

Posted on 05/08/2007 11:58:06 PM PDT by Jim Robinson

The power to pardon traditionally belongs to the president. But Representative Duncan Hunter, who is seeking the 2008 Republican nomination, isn’t waiting for Inauguration Day.

Mr. Hunter introduced a bill in January to initiate an unprecedented Congressional pardon of two former border patrol agents currently serving 11- and 12-year sentences after shooting a drug smuggler on the Texas-Mexico border in 2005.

For Mr. Hunter and other immigration hardliners, their conviction is an “extreme injustice.”

While Constitutional objections are “very much a possibility,” said Joe Kasper, Mr. Hunter’s spokesman, he doesn’t see the measure threatening executive power. The president’s required signature on the bill “would obviously be synonymous with his authority to execute a pardon,” he said. “The Congress is doing nothing more than initiating a pardon.”

Well, sorry, but as great as you apparently think I am about convincing others to change their minds, I’m just not capable of turning around a hard charging herd of hysterical RINOs. But we all know where they are. Maybe someone else can go over and try to convince them that we’d have a better shot of defeating Hillary if we DO stick to our principles and run a conservative so we give the voters a clear choice. Not to mention NOT destroying our cause and or the republic in the process.

This guy gets it. He should have his own website or something...

You can’t expect others to respect and consider your position if in return you don’t respect that they have a right to their own.

Hey, they may have a right to their opinion, but they don't have a right to express it here--just like I don't have a right to express my opinion over at the DUmp.

You both have to be AT THE TABLE for communication to take place.

Fine. You set up a website called "www.atthetable.com" and allow people to "communicate" however they want on political issues. Let me know how that works out for you, ok?

I've been on such message boards and they quickly devolve into a screamfest between the Stormfront people and the DailyCossacks. Decent people tend to want no parts of that.

No way. My fence stands firmly at the abortion/gay agenda/gun grabber line. And no abortion supporter sticks his nose under my tent. The government sanctioned murder of millions of the innocent unborn in the womb is about the most evil thing I can think of. “Father, forgive them, for they know not what they do.” Good night.

Are you sure, though, that Article 2, Section 2 FORBIDS Congress from redressing this injustice in this way?

Government offices only have the powers granted to them by the Constitution. Only the President is given the power to pardon. The Constituion grants Congress no powers of pardon.

As I stated, get it straight.

You had the opportunity to quote the testimony where Ramos and Compean supposedly testified "they were aiming for the back of his torso on each and every shot". You didn't provide the quote. That is due to the fact that they did not testify what you asserted. You have a habit of making things up.

The actual testimony from volumes 12 and 13

Ramos vol 12 page 209
3 Q. And is that what you saw, was -- I mean, I know you used
4 your left hand. Is that what you saw?
5 A. That's what I saw.
6 Q. Okay. Are you absolutely sure that he had a gun in his
7 hand?
8 A. On that day, at that time, I believe so.
9 Q. Okay. Were you absolutely 100 percent sure?
10 A. At that time, I was.
11 Q. Okay. How about today, looking back on it? Do you think
12 he had a gun or do you know?
13 A. I can't be sure.
14 Q. Okay. You can't be sure. What do you think?
15 A. He had something in his hand.
16 Q. Okay. Now, what did you do when the suspect made the
17 motion that you just demonstrated? What did you do?
18 A. I picked up my gun and fired.
19 Q. Okay. How many times did you fire?
20 A. One time.

Ramos vol 13 page 74

23 Q. He's running, you said, Parete -- trying to get back to
24 Mexico. But when you say, Parete, he stops and turns around to
25 shoot at you, correct?

Compean vol 13 page 162
1 A. He started running. I looked up, and I saw him running
2 away. A few seconds later I saw him turn around, and he was
3 pointing -- he was pointing something at me.
4 MR. ANTCLIFF: I would ask that he be allowed stand
5 up, Judge.
6 THE COURT: Sure.
7 BY MR. ANTCLIFF:
8 Q. Show the ladies and gentlemen -- stand up. Show the ladies
9 and gentlemen of the jury how -- what you're talking about
10 right there.
11 A. He was running. He was -- he started running away from me.
12 And I saw him turn, and he started -- and he kind of did -- did
13 this (indicating).
14 Q. Did you see -- you can sit down.
15 Did you see a gun in his hand?
16 A. I couldn't tell for sure. It looked -- it looked like a
17 gun to me.
18 Q. What, specifically, did you see in his hand?
19 A. It was something black, shiny, in his hand.
20 Q. At -- black or shiny?
21 A. Well, it was like a shiny black.
22 Q. Okay. At that moment, were you in fear for your life?
23 A. Yes, sir, I was.
24 Q. What did you do?
25 A. I immediately drew my weapon. I was -- I believe I was
1 down on two knees. I came up on one knee and began firing.
2 Q. So you -- on one knee, you're firing at him?
3 A. Yes, sir.
4 Q. Do you know how many times you fired?
5 A. It had to have been approximately -- from what I had
6 mentioned to Agent Sanchez, it was about 10 or 11 rounds.
7 My -- my gun never went empty, so it couldn't have been more
8 than 12.

I was going to call him on the imaginery surgeon’s testimony, but it isn’t worth the effort.
Some folks see what they want to see, even when its not there.

So, neither of the officers testified they saw a gun in his hand.

Ramos testimony, Volume VIII, page 88-89

20 Q. Agent Ramos, you are trained to shoot to kill, correct?
21 A. To stop the threat.
22 Q. You are trained to shoot at center mass, correct?
23 A. Yes, ma’am.
24 Q. To shoot somebody in the heart?
25 A. Well, if center mass includes the heart, I guess so.
David A. Perez, CSR, RPR
Ramos - Cross by Ms. Kanof 89
1 Q. As a firearms instructor, you train people, shoot to kill,
2 correct?
3 A. Yes, ma’am.
4 Q. And if this was not a good shoot, then you just killed him,
5 correct, if he had died?
6 A. I’m sorry?
7 MS. STILLINGER: Objection, Your Honor. He didn’t
8 die, and that’s a hypothetical I don’t think it’s proper to get
9 into.
10 MS. KANOF: I’ll restate my question, Your Honor.
11 THE COURT: All right. Please restate.
12 BY MS. KANOF:
13 Q. You hit him in the buttocks, right?
14 A. Yes, ma’am.
15 Q. And it severed his urethra?
16 A. Apparently.
17 Q. And there’s no way anybody can really tell whether he will
18 ever have his urinary function back, correct?
19 A. That’s what the doctor said.
20 Q. Okay. So were you not shooting at center mass?
21 A. Yes, ma’am, I was.
22 Q. Okay. You were shooting at center mass?
23 A. Yes, ma’am.

This is the last time you call me a liar. You did not read the transcripts, you post selected sections other people have given you. You’re objecive is to misdirect and misinform and nothing yo say can be trusted.

If you’re right, if this was a good shoot, why do need to lie?

Ramos Testimony, Volume VIII, pages 74-75

23 Q. He’s running, you said, Parete — trying to get back to
24 Mexico. But when you say, Parete, he stops and turns around to
25 shoot at you, correct?
David A. Perez, CSR, RPR
Ramos - Cross by Ms. Kanof 75
1 A. He doesn’t stop.
2 Q. He’s running with his — how can he run and look at you to
3 shoot you at the same time?
4 A. I just know what he did, ma’am.

Ramos testifies OVD is running full speed, never stops during the time of the shoot.

Doctor Testimony, Volume IX pages 201-202

THE COURT: I just want it clear, because I’m confused
10 about something I just want to clear up.
11 I think Mr. Peters asked you that the — where — the
12 bullet ended up in his leg, which was towards the front, right?
13 THE WITNESS: Yes.
14 THE COURT: That if he had extended his leg, once the
15 bullet hit, and it was deflected, that would be consistent with
16 that leg being extended, I thought you said. Am I
17 understanding that?
18 THE WITNESS: Well, the limb could move, obviously, in
19 such a way as to allow a bullet to go and — end up in a
20 variety of places.
21 THE COURT: Well, I guess my question is — is —
22 does — because if he’s turned, and — are you saying he can be
23 turned and limb extended for that to happen? Or is he
24 turned — I’m just trying to understand the angle that you’re
25 talking about for the bullet to go in there, hit the pubic
David A. Perez, CSR, RPR
202
1 symphysis, and then end up in the front of the leg. Can both
2 of these things be happening at the same time, where his leg
3 extended, and he’s turned, and he’s doing all those things, for
4 that to happen?
5 THE WITNESS: Well, I guess I’d want to clarify what
6 we’re talking about with extension —
7 THE COURT: Okay.
8 THE WITNESS: — extending of the leg.
9 THE COURT: Okay.
10 THE WITNESS: A lot of people, you would think
11 extension is the leg out in front.
12 THE COURT: Right. That’s what I thought you said, or
13 someone said.
14 THE WITNESS: That’s correct. The leg would have to
15 be out in front for it to get there.
16 But, in medical terminology, extension of the leg is
17 actually going backwards.
18 THE COURT: Okay.
19 THE WITNESS: So what I meant was, yes, it would
20 appear that the leg, if it was extended to the front, it would
21 have allowed the bullet to end up where it ended up.

Ramos testifies OVD is running when he shoots. The doctor testifies the wounds are consitent with the right leg extended in front (as if running) at the time the bullet entered.

Now do a little experiment. Stand upright with feet together and head pointed north and take something flat, like a ruler or yard stick and lay it across the back of your behind. The ruler points east and west. Keeping your left foot planted, extend you’re right foot three feet in front of you, as if you were running.

Where is the yardstick (butt) pointed now? It’s pointed southwest to northeast and at an angle exactly consistent with the trajectory of the bullet as testified by the Doctor.

Let’s play a little Occam’s razor.

OVD was in full stride and manages to pull a gun from his waistband (a gun that Compean didn’t notice or knock loose during the alleged fight on the ground at the levee) or from his pants pocket (either it was an extremely small gun or very large pocket) then manages to turn 90 degrees, point the gun at the BPA’s with his left hand (even though he is right handed) without falling down and continuing to run, doing all this when he is literally feet from the safety and freedom of the Rio Grande and knowing that there are multiple BPA’s with their guns drawn and aimed at him with at least one BPA who already shot at him 15 times.

Or,

OVD was running.

Like I said—it wasn’t worth the effort. You consistently excerpt portions of the testimony while ignoring others and making up conclusions. At this point, I wouldn’t trust you to tell me what time of day it is.
