Today's Giuliani Agrees With Court Decision

Here's Rudy Giuliani's statement on today's Supreme Court decision upholding a nationwide ban on partial-birth abortion.
"The Supreme Court reached the correct conclusion in upholding the congressional ban on partial birth abortion. I agree with it," Giuliani said in a statement.
Since he announced his intention to run for President, Giuliani has sought to side with the vast majority of conservative voters by calling for the court to uphold the government ban.
Giuliani used to oppose the ban. His campaign has said that he did so conditionally -- that he opposed the ban in the past because it didn't allow for the controversial procedure even in cases where it may have saved the mother's life.
But when asked about the proceedure on 'Meet the Press' in 2000, he sounded clear on the point, saying that he "would vote to preserve the option for women."
And when asked about the possibility of his supporting Bush's push to ban the procedure during a CNN appearance in 1999, Giuliani said "No, I have not supported that, and I don't see my position on that changing."
Wow! He is really giving it the old college try. He wants this Presidency thing.
Flip-Flop!

Giuliani’s formula is brilliant: I’m against abortion unless I am for it.
He would not have said such a thing in 2000 when he was running for the senate. I do not believe him and I do not trust him.
It’s not really a flipflop...you can interpret his statement as keeping the abortion debate in the Congress and out of the Courts.

Giuliani stated that he supported Clinton's veto of the PBA ban. Now he says that the court is correct to uphold it.

Ive said that Ill uphold a womans right of choice, that I will fund abortion so that a poor woman is not deprived of a right that others can exercise, and that I would oppose going back to a day in which abortions were illegal, Giuliani told talk show host Phil Donahue during his first run for mayor in 1989.
If the ultimate choice of the woman my daughter or any other woman would be that in this particular circumstance to have an abortion, Id support that. Id give my daughter the money for it, he added.
Giuliani went even further a decade later, when he voiced support for partial-birth abortion, a practice that is opposed by an overwhelming majority of Americans.

There is no contradiction in saying that a law is a bad idea and yet the supreme court is right to say that Congress may pass such a law.
(This is not a comment on whether, or if so, why, Rudy has changed any position — just a flat statement of the difference between wisdom and constitutionality). Lots of stupid laws are constitutional, and even some wise ones are unconstitutional
