My impression about this ruling is that while it affirms the ban on only the most grisly form of abortion, it ALSO re-affirms the “right” (disguised as “privacy”) of women to kill their kids at will.

I’m not so sure that anti-abortion folks have much beyond the partial-birth ban to celebrate here.......

Anyone notice that Thomas left open the possibility to readdress this issue as a violation of the commerce clause.

PBA law is ripe for a new challenge.

Hopefully all our tax money sent to the UN for abortions in other countries we have to fund (for some unknown reason) will now stop.

My hyper-liberal law prof made sure to note, in class, how to destroy a law or ruling: find an exception, get it recognized, then expand the exception, then expand the number of exceptions until the original law/ruling is meaningless.

(Not that she used class as an activist training ground or anything.)

God does answer prayer! Let's be sure to thank Him for this victory over Satan, the enemy of life. Now lets get on with asking God for a reversal of Roe v Wade, which has killed tens of thousands of unborn babies for every one that was killed by PBA.

Overturning Roe won't end legal abortion, but it will take the issue out of the courts and put it back to the people via the state legislatures. IMHO the best we can hope for if Roe is reversed would be perhaps 2/3 of the states would ban abortion on demand, but most would allow abortion for rape, incest, and life of the mother cases.

Personally, I would allow abortion to save the mother's life, but I would require a consensus opinion from a broad panel of medical doctors that her life is in imminent danger if the pregnancy is not terminated. But IMO killing an unborn baby because it's father was a rapist or an incestuous relative amounts to killing the most completely innocent party involved in the crime. (Not to say that rape victims bear any guilt for the rape, but she can't be any more innocent than the unborn baby) If the mother is too traumatized or otherwise unable to keep the baby there are hundreds of thousands of eager couples waiting to adopt newborn babies. We shouldn't allow compounding the original crime by aborting the innocent baby.

Why the drop after 1960? (in deaths of women from illegal abortions)

The reasons were new and better antibiotics, better surgery and the establishment of intensive care units in hospitals. This was in the face of a rising population. Between 1967 and 1970 sixteen states legalized abortion. In most it was limited, only for rape, incest and severe fetal handicap (life of mother was legal in all states). There were two big exceptions — California in 1967, and New York in 1970 allowed abortion on demand. Now look at the chart carefully.

So how many women’s lives have been saved by abortion?

Only about 3% of abortions since 1972 were reported to be “due to a risk to maternal health.” A reasonable person would recognize that not all of those cases represent a lethal risk. But let’s say they did. That means that nearly 45 million fetuses were butchered to save the lives of about 1.3 million women. Or put another way; 35 babies are killed to save each woman.

Abortion was legal in all 50 states prior to Roe v. Wade in cases of danger to the life of the woman.

If RvW is overturned, how many states do you think will outlaw abortion? 5? 10?

The ruling did not make partial birth abortion unconstitutional; it allowed the law against it to be upheld.

It is not the first step if there are no further steps to come. The dissent on this was very hostile, and you can be sure Ginsberg and Stevens will stay on the bench until the coroner has to come and get them. Bush will not get another nomination, and Hillary’s wont be pretty. Enjoy the 5-4 while it lasts.
