WASHINGTON — The Supreme Court upheld the nationwide ban on a controversial abortion procedure Wednesday, handing abortion opponents the long-awaited victory they expected from a more conservative bench.
The 5-4 ruling said the Partial Birth Abortion Ban Act that Congress passed and President Bush signed into law in 2003 does not violate a woman's constitutional right to an abortion.

On a side note, it is so exciting to see the liberals over at the DUmp and Daily Chaos with their panties in a bunch and fraught with rage. But...but...but!! Kennedy actually resisted the siren call of the cocktail set in D.C. and held to his original position when it actually mattered.

A quick read of the law which was upheld reveals it defines partial birth abortion, then criminalizes performing such a procedure. There is an exception for the life of the mother.
I believe the law was constructed to restrict based on method rather than the term of pregnancy because Planned Parenthood v. Casey overturned such laws.

You are speaking to a PRO-LIFE forever, charismatic Catholic who is more evangelical than most evangelical. I categorically don’t believe that only Rudy can win ... I think most of the well mentioned Reps have at least a decent chance to beat Hitlery, and “electability” will not play into my decision for the nomination. It WILL play a part of how I choose to vote in the general, though.

Unfortunately there is a giant loophole in the decision:

So all the doctor has to do is give the baby a lethal injection prior to the procedure. At least a trifle more humane than tearing a live baby limb from limb, but it will hardly put a dent in the abortion mills.
