WASHINGTON — The Supreme Court upheld the nationwide ban on a controversial abortion procedure Wednesday, handing abortion opponents the long-awaited victory they expected from a more conservative bench.

The 5-4 ruling said the Partial Birth Abortion Ban Act that Congress passed and President Bush signed into law in 2003 does not violate a woman's constitutional right to an abortion.

Only because Bush was such a wimp. Reagan and Bush 41 got nominees through the Senate.

I nominate this for dopiest post of the year.

Methinks that those calling this courageous President 'a wimp' are lacking the courage he has, and are deeply jealous.

No self-assured male thinks President Bush is 'a wimp.'

It’s a flat-out lie, pushed by liberal republicans to smear conservatives. It simply didn’t happen, and the number bear that out. The Dems won because the independent vote broke 65-35 against the Republicans.

I agree. Also, voters that are primarily fiscal conservatives and/or libertarians who are usually reliable republican voters either stayed home or voted 3rd party.

The social conservatives had absolutely no reason to stay home even though some in the south were duped by "conservative" democrats like Heath Shuler.

At least three myths debunked by this decision:

Myth #1: There's no difference between electing a Republican and a Democrat president.

Myth #2: The debate on abortion is over in this country, and social conservatives have lost.

Myth #3: A presidential candidate's position on abortion is not important, because the president has little affect on abortion policy.

From what I remember, all the testimony in the lower court cases showed that there would NEVER be a situation where a partial birth abortion would be needed to save the mother.

You're correct. There's not a single health problem this procedure "cures" that couldn't be treated with a Caesarean section or a vaginal birth.

Truly sick, especially when you consider a lot of these kids are suffering from Down's Syndrome or cleft palate.

Amen! Hopefully this will shake a few Rudy supporters up. It's only a matter of time before Ginsberg retires/expires. And I can guarantee you, right now, she's only hanging on hoping HilRud will get elected.

I agree...late-term (partial birth) abortions are murder because the fetus/baby is generally viable at that point with current medical technology...and I’m a godless heathen atheist who thinks religion and mysticism is a complete waste of time...I agree on purely scientific grounds.

Great! Finally, someone who can use actual logic. Now, tell me, going backwards from the point of viability, at what point scientifically does the unborn child stop being a human life? Consider DNA, metabolic activity, growth, movement, response to environment, etc.

This wasn’t a commerce clause law...the 14th Amendment applies.

“I’m so tired of the all-or-nothing conservative wing I could puke. These selfish people are going to lead us to eight years of evil and darkness fom which we may never recover.”

You are wrong. Its those that are pushing for a “Nothing” candidate like Rooty Ghouliani that will get the Rats elected!

You can’t win anything with half the party staying home.

Wake up.

“The term “conservative” means more than just anti-abortion.”

I couldn’t have said it better myself.

Still, that being said, I am overjoyed at this decision upholding the PBA ban.

It is not possible to be anti-life and also be conservative.

Life is not an “issue;” it is a RIGHT granted by our Creator. To attempt to reduce it to an issue is incredibly self-indulgent.

The Declaration presents it as the FOREMOST Right (Life, Liberty, & Pursuit of happiness.) Indeed, without Life, all other rights are of no consequence. Dead men don’t care about liberty and happiness.

The Constitution enshrines the RIGHT of Life in the Bill of Rights when it says that we shall NOT be deprived of LIFE without due process of LAW...in other words, without sincere, debated, responsible LEGISLATIVE parameters. There is no such requirement for some woman’s right on her own to take a life.

LIFE cannot be taken without CONGRESSIONAL laws setting parameters. That debate had never taken place, since the COURTS had swept away CONGRESS’ power to decide such things.

This bill is a CONGRESSIONAL input into the debate. It is NOT an intrusion.

This is the way it is supposed to work according to America’s Constitution.

THANK YOU PRESIDENT BUSH for courageously walking your pro-life talk! . . . and please know that we are praying for you as you continue to uphold the moral/untilitarian efficacy of ADULT vs embryonic stem cell research!

Amen, Deb! Thank You, Lord for giving us a President who has worked for a culture of LIFE so consistently.

I second your comment.........we may not see his like again.

This ruling is a pyrrhic victory at best. The Supreme Court upheld a federal ban on an abortion procedure. Where does the U.S. Constitution give the federal government the power to ban abortions?

The 14th Amendment. Due process clause.

On purely scientific grounds, the most sacred argument of the pro-abort crowd (”A woman has the right to do whatever she wishes with her own body”) falls flat on its ugly face. VIRTUALLY ALL successful abortions kill an individual with unique DNA, and it’s not the pregnant woman. Biology at its most basic.

The 14th Amendment gives Congress the authority they needed here. It’s in the due process clause.

It is not possible to be anti-life and also be conservative.

My point was that a person can be pro-life and still a socialist.

Regardless, a person can be a fiscal conservative and either uncaring about abortion or even pro-choice. The terms "liberal" and "conservative" are just terms and have flip flopped over time. Today's "conservatives" would actually fall into the category of "classic liberals".

The lie that conservatives stayed home en masse on election day and inflicted a left-wing Congress on the country as punishment for a lack or “purism”.

It’s a flat-out lie, pushed by liberal republicans to smear conservatives. It simply didn’t happen, and the number bear that out. The Dems won because the independent vote broke 65-35 against the Republicans. That’s it.

Methinks you are right ... and it deserves repeating.

Although in some cases this falsehood is being pushed by disgruntled conservatives, too ... "we told you the GOP shouldn't have abandoned its base."

IMO, the '06 debacle was an Iraq thing ... and to try to draw broader electoral lessons from it ... or to try to use it to batter one another ... is a mistake.
