WASHINGTON — The Supreme Court upheld the nationwide ban on a controversial abortion procedure Wednesday, handing abortion opponents the long-awaited victory they expected from a more conservative bench.
The 5-4 ruling said the Partial Birth Abortion Ban Act that Congress passed and President Bush signed into law in 2003 does not violate a woman's constitutional right to an abortion.

Next president WILL appoint a justice. There will probably be a democrat majority in congress. So we need a solid conservative who won’t be inclined to let the democrats pick which “strict constructionist” to appoint.
Rudy has shown that when there are obstacles in place to appointing good conservative justices, he is happy to go along with those obstacles so long as the justice meets his definition of “fair and honest”, which according to Rudy includes finding that Roe is settled law.
I held my nose and voted for Bush in the last election - its finally paying off ...
