I recall reading some fairly in-depth article about that. As I understood it, a Clinton holdover was in charge of the investigation and basically proposed charges and agreed to a favorable plea-bargain before (supposedly) those at higher levels were even aware that there was a case. Once that’s done, you can’t go back and do it over again because of ‘double-jeopardy’...

I'd also like to know why Berger was never questioned while connect to a truth detector as he agreed to in his agreement.

Amazingly no one in this justice department has ever been interested enough to actually question Berger while connected to a truth detector to find out what he was trying to cover up or what in total he actually stole and destroyed.

Alberto was not AG then. It was the fellow from Missouri John Ashcroft. As he blew the Gorelic (sp) cover to the 911 Commission I do not believe he knew about the Berger caper. I suspect DoJ lifers and Clinton holdovers kept it from him and Bush appointees. They were probably covering their asses.
