'Duped dads' fight back in paternity cases

JEFFERSON CITY — David Salazar is what many would call a "duped dad."

Repeatedly, courts have ordered him to pay child support for a 5-year-old girl, even though no one — not a judge and not the child's mother — claims he's the father.

In the eyes of many, Salazar, of Buchanan County, is the victim of a law that traps men into the child support payments, even though they can prove they're not the dads.

That kind of statement angers Sen. Chris Koster, who is sponsoring the Missouri bill.

Koster, R-Harrisonville, said he knew children would be harmed as men used DNA to break paternity. But he said the current law mocked justice by pretending that a man is a father even when the evidence proves otherwise.

His bill would allow men to bring forward DNA evidence at any time to prove they are not obligated to pay child support.

Linda Elrod, director of the Children and Family Law Center at Washburn University, said she was saddened by cases where DNA evidence was used to challenge paternity. She said the cases not only cut off support payments but often ruptured a mature parental bond.

Others, such as Jacobs, want to set a two-year deadline for using genetic tests to challenge paternity. She said courts also needed the discretion to weigh the quality of a parental relationship and the best interest of a child.

But Koster said such arguments by law professors ignored the fundamental truth in many cases — that the man is not the father and should not be obligated to pretend he is.

"It would be just as arbitrary to hang the responsibility of supporting the child with those professors," he said.

does that make them all dishonest people, or does it make them people who have been dishonest?

If this goes on much longer, I may need to take a bath. Listen, I believe in sacramental confession with a priest that takes away sin. If an adulterer makes it right with God, great. And the people they've offended can forgive them, too.

But if someone's got an obvious, flapping moral weakness that has her putting Old Number One ahead of principle, it does her no favors to put her in the way of temptation. I might send a card on Mother's Day, but put my money elsewhere. Prudence is a virtue.

The study’s finding of 25% struck me as absurdly high but this was a UK study and had to be limited. There was no indication that it applied to the whole population.

They probably limited the study to chavs, pikeys, and cockneys.

What we here in the States call "trailer trash".

There is a HUGE double-standard and it's just flat out WRONG.

Damn straight.

Try this one on for size: Two bank robberies, both involving a handgun, both with the take being the same.

Now, the difference is that one robbery is committed by a 30-ish black male, the other by an attractive white female in her early 20's.

Do they serve the same sentence? Probably not.

Actually I would not make any accusation of arrogance. I think that Hitman has taken quite the beating. Let’s see, he loses on points, he loses on weight of argument, he loses on the audience’s evaluation.

If this guy held a lawyer position, he’d be the equivalent of a lawyer named Nifong. If he was a lawyer in Cuba, China or certain regions in Europe, he’d be running for national office to dispense his wisdom upon the masses.

OMG, romanesq! You just cracked up me, my son, and my girlfriend with that one, with Nifong being the poster child of mad-dog, out-of-control prosecutors trying to use their position as a stepping stone for higher office.

Nifong gambled, he lost, and now he's a joke. Sweet. I love seeing prosecutors who fail to control their ambitions destroy themselves.

Prosecutors are, more often than not, much like Islamist fanatics - rabid dogs who will destroy anyone they can, so long as it results in the accumulation of their own personal power.

That is why I reject this bastardized definition of manhood, a requirement that any man should be a chump, that the actions of others are irrelevant to the question of his obligations. This mentality is at the root of our family and cultural breakdown.......

I have harbored the following thought for many years...it goes like this...from what I have observed in the courts, yes, I have been there....it appears to me, that there is sadistic delight, prevalent with the males of the court, when they whip the offending male with divorce legalese....it is as if almost they are saying, well if you(the offending male) were a REAL man, you would not have all these matrimony problems, so, we, the court males despise you, and you are going to suffer, where it hurts a male the most, in the wallet....when I was before the courts, my lawyer said to me....you are a man, so you should expect to take a big hit....

Funny, but what I have described and defended is closer to the actual law of the land than what many other posters have written about - ‘so much for taking a beating,’ I suppose.

You might dislike what I posted for any reason, but it doesn’t make me any less right.

No, what you suggest is that your position is “closer” to the law and that people who don’t accept it are not “he-man” by your supreme order.

Neither of which is impressive to most folks on this thread. The only place where such is “closer” to the law is fascist/socialist states where fairness has nothing to do with the imposition on the populace.

You’re wrong by the very rejection of your idea by most everyone on the thread.
Of course you might attempt to impose your views on others. There are always people attempting to do such. I believe Hillary also wishes to impose her socialistic vision for what she deems as good.

But since you are childless, the irony is only more pointed in your socialistic imposition.

Do you really think he would be a "loving father figure"? Unless a saint withing the narrow definition used by the Catholic church, his resentment will play out in a number of ways, every single one detrimental to the child, especially a girl.

Even real fathers do this. What evidence do you have the great or even the simple majority of men in this situation will act otherwise? Or do you think this is just something that "oughta be" and willing to impose that attitude by force of law?

Don't you think a man should have a choice in this instance? Do you think that the deeply felt and experienced betrayal, with forced depletion of his work and time, causing him lack, even poverty, will make for a just and stable society?
