Right. Shooting a 13 year old 95 lb. boy in the back was just one of those "unfortunate consequences."

Weaver was essentially saying that, in hindsight, it would have been better to have gotten his family out.

Yes and that's all I'm saying. I know a lot of "gun nuts" and White Supremacists and they don't get their families involved with stakeouts by the FBI.

My bet is that they shot the dog first, just SOP, the kid may have instinctively shot back and turned to run away and that is when they shot him. I do not recall the specifics of the Marshall's wounds or the ballistics reports, but seem to recall seeing information that he had discharged his firearm several times (cartridge cases on the ground).

If anyone has data which can clarify that, please post it.

And what, pray tell, was the underlying crime, the resolution of which required a military/commando style assault on Randy Weaver's home and family?
Weaver failed, or declined to attend a scheduled federal court hearing dealing with his crime of shortening the barrel of a shotgun, an act which he had been induced to perform at the request of an undercover agent of the U. S. Government. The feds hoped thereby to compromise him, expecting that he would provide info regarding white supremacist groups with which they alleged him to be affiliated. No specific evidence of such affiliation ever was reported by the press, which nonetheless described Randy pejoratively as a white supremacist, or an associate thereof.
His wife and child paid a high price, as did Randy and the rest of his family.
(Apropos of nothing in particular, I will note that I am a resident of northern Idaho, and also not a white supremacist).

And, moreover, Randy Weaver could have been apprehended harmlessly during one of his visits to the village of Naples; much as David Koresh could have been apprehended during one of his visits to Waco.

Those who post *details* about the incident in this thread are people we should all be wary of because they took the time to study the facts. They are people who obviously do not trust big government.

I seem to recall that the barrel legal was "legal", but the overall length of the shotgun was too short -- less than the minimum of 26". Weaver modified the stock at the request of the undercover agent, making the overall length 1/8" too short.

Actually, this occurred well beofre Waco. The sniper who pulled the trigger on Vicki, was advising the snipers at Waco.

Correction to my post above. Here's the sequence of events...

A surveillance team of six marshals went to the mountains on August 21, 1992 to look for places to station cover teams for the operation. Toward the end of the surveillance mission, one of the Weaver's dogs began to chase three of the marshals. Marshals stationed at an observation post saw Kevin Harris, an associate of Randy Weaver, Weaver, his thirteen year old son Sammy, and Weaver's daughters, follow the dog. All were carrying firearms.

The marshals retreated. As they approached an intersection of trails known as the "Y," they saw Randy Weaver coming down the trail. They identified themselves and told him to halt, but he turned and ran back up the trail. The dog caught up with Deputy Marshal Cooper. He held the dog at bay with his firearm, but did not shoot for fear of provoking the Weavers. An exchange of gunfire occurred moments later, resulting in the death of Deputy Marshal William Degan, Sammy Weaver, and the dog.

According to the marshals, the fire fight began when Degan and Deputy Marshal Cooper rose to identify themselves. Kevin Harris wheeled and fired at Degan with a 30.06 rifle. Cooper returned fire and thought he hit Harris, though he had not. Cooper turned his weapon toward Sammy Weaver, but did not fire.

Deputy Marshal Roderick, who was further down the path, heard a shot from his left. Roderick could not see anyone other than Weaver's dog, which was heading in the direction Randy Weaver had gone. When the first shot was fired, the dog turned its head toward the marshals. Roderick feared that the dog would turn and attack him or lead Weaver, Harris, and the others to the marshals. Roderick fired at the dog, killing him.

As I remember this,, Weaver was framed by the Government. This whole thing was insane. They wanted him to infiltrate some kind of anti government group or racist group, and he wanted no part of it. So then they trumped up charges on him. They changed dates on his court appearances and he failed to show. After that, it wasn't a matter of him "holding himself up" the guy was fearing for his life. Where was he going to run to?? The police?? The police were surrounding his home! The judge in the trial even held the ATF in contempt. This whole thing was complete insanity. His son was shot in the back running away! Randy Weaver may have been a little off in his beliefs, but he was also a decorated Vet, that really just wanted to live on his own land and be left alone.

Weaver's trial was in process while Waco was going on. It was said to have had an effect on the jurors, favorably for Weaver.

Bill Clinton was inaugurated on January 21, 1993. The Ruby Ridge Massacre took place on August 22, 1992. What am I missing here?
