Libby (Trial) Update {Juror Dismissed From Case }

Not sure what this means — but we've just gotten an announcement that the parties in the Libby trial have been asked to come to the courtroom at 9:45 this morning. Could be some sort of inquiry, or it could be bigger.

If there is a quick verdict now, it will be "tainted". If it is guilty, it will bee seen as a "prosecution stunt", if not guilty, it will be seen as a "defense stunt"

Back from a week of 89 degrees and sunny at poolside in Manzanillo ... to 3 inches of snow in New Jersey. Trying to catch up but still take one more family day away from the fray.

Byron's post is very interesting. Defense lawyers virtually always move for a mistrial when a juror has to be stricken during deliberations. Reason is obvious: Jury must be unanimous to convict, and it's tougher for the prosecutor to convince 12 people than 11. Almost always, these mistrial motions are denied. Federal rules allow the judge to accept a verdict from 11 jurors regardless of whether the parties agree. (If it gets under 11, that's a different story.)

Byron seems to be saying Ted Wells, far from objecting, actually asked for the deliberations to continue with 11 jurors. That is a sign that the defense is very confident and obviously likes this jury.

This makes me wonder how I'd feel if I voted to convict or acquit somebody and then got out and found they had kept information from the jury that would have changed the verdict.

I just wonder if the jurors are getting sick of this and will come to a faux unanimous decision .. just to get it over with. Guess it depends on how strong the jury foreman is .. and how much sway the released juror had on the minds of the group.

Prayers for Scooter and the eventual revelation of the whole truth about Fitz and the MSM hacks.

I hope Clarice is there ... Byron, and maybe, Victoria Toensing.

Wells seemed very eager to go ahead, Fitzgerald wanted to seat a new juror and start all over.

I'm betting that the juror who was dismissed was seen by Wells, from pre-trial juror questioning, as a very pro-prosecution juror and that Fitgerald knew that losing this juror would hurt his chances of a conviction.

The one who wouldn't wear the shirt. I'm not a conspiracy theorist, usually, but this sounds like a set-up. What a coincidence that she's the only tainted juror and how would any of them know?

If this was leaning 11-1, then maybe Libby wants the taint on the whole thing. If you're a Libbylawyer, you're probably thinking that the alternate would vote yes, so you use this to cloud the verdict.

I sure hope Byron and Ted are correct.
I don't know what to make of this since everyone at the DUmp is as pissed off as fine patriotic FReepers.
I continue to pray for Libby as everyone else plays a game with his future.

All I have really hoped for is a hung jury..because I just think this has all been a set up to "get Cheney" in real life, and this is the scumbags consolation "prize", to get Libby.

TOO much politics about the war was let in by the judge, from Fitzy....and we know with a DC court, they are going to think political anyway.

How could this Judge let one Juror go without calling it a mistrial? How could the remaining 11 make a sound decision when notes have been passed to the jury from the media? Is this judge a Clinton appointee?

The one juror who apparently declined to don a T-shirt was a woman who had been a curator at the Metropolitan Museum of Art.

If she's a maverick and pro-defense and it was leaning 11-1, then Libby's lawyers would not want her replaced, given that she'd have to leave anyway. This would taint the verdict.

If she's pro-prosecution (and a 70-year-old female former director of MOMA screams "moonbat" to me) then maybe she was a single holdout. I have to say that I like her for not going with the t-shirt stunt.

2 1/2 days speaks of a hung jury in this case. The idea of putting a man in jail for "supposedly" lying to a Federal Agent while other people in the case have "protected" status is "absurd justice".

If Wilson hadn't been the secret agent sent to Niger BY THE DEMS....NONE of this would have ever happened.
