BTW, many of you may not have noticed. But as of March 14, 2007, EVERY means of access to the internet, except for dialup, will be REQUIRED by the federal government to be tap and record the use by ANY specific user.
Yes, your VOIP phone. Yes, your MSN Messenger chats. Yes, your email. Yes, the content of any website you may visit... OR ANY SOMEONE WHO USES YOUR CONNECTION may visit.
What else is going on? Guess who has to pay for this? The feds? Nope. Your ISP, your phone company, your company (yes, if your company has a network that connects you to the internet, IT TOO HAS TO COMPLY! ).
Scattered across the country, are scores of thousands of small ventures. Some of them are informal arrangements to bring fast internet to a remote neighborhood, some of them are "free" networks brought into existence by computer geeks. Some of them are small ventures where "broadband" (any connection faster than 5X dialup speed) must comply a long list of federal regulations, from registering with the FCC to be "counted" for reporting to industry and Congress, and to comply with a complex set of rules for compliance with wiretapping.
The first federal deadline is tomorrow, Feb 12. On that date, you have to file "compliance" statements. Either you are (and how you are) or if you aren't, how you are going to.
You are expected to list your network topology, equipment manufacturers and methodology for compliance.
Yet, most ISP's have no idea yet how they intend to comply. Few can.
A few companies offer the data sorting and extraction services remotely... The estimated cost for the device alone is $100,000 for that kind of service.
The program is called CALEA, or Communications Assistance to Law Enforcement Agencies.
The federal goverment is taking the stance that they demand what they want, and industry is left to define how to do it - to create standards on their own.
Guess who creates the standards? The big guys. Cisco, Telephone companies, network providers. Guess who they want to put out of business? Small providers.
Internet services was the bright star of our economy. ANyone could become an ISP. Countless small companies have created a serves and data revolution that has fueled our economic engine for the last few years.
We may not know it yet. We may not have noticed it yet. But the ISP business is dead. It has been usurped by the federal government, taken over. Network design and operations are now controlled by Big Brother. Technologies and operational techniques are now mandated by federal desires to NOT HAVE TO DO ANY WORK to spy on you.
I have devoted the last 4 years of my life to building, from NOTHING a broadband business, to bring services to areas that will never get them otherwise. I have yet to earn a paycheck. Every dime I have been able to get through sales has been reinvested in this venture.
And I am seriously considering writing my customers letters tomorrow, explaining that as of a short time from now, they will have to find a new provider, as I will have to abandon the business, as I have no money with which to fund "compliance".
One more example of runamok government.
Common carriers, facilities-based broadband Internet access providers, and providers of interconnected Voice over Internet Protocol (VoIP) service – all three types of entities are defined to be “telecommunications carriers” for purposes of CALEA section 102, 47 U.S.C. § 1001 – must comply with the CALEA obligations set forth in CALEA section 103, 47 U.S.C. § 1002. Every time I read that I just shake my head :(
I have devoted my last 4 years to building a Internet Service Provider. I started with a friend and $5K each, which is nothing these days. With blood, sweat, many 20 hour days and late nights, missed kids concerts and even some anniversaries, financial sacrafice and hardships... I have prevailed against all odds. WE now have competitive service that can and does compete with the Telco, Cableco, and is expanding to areas not serviced by ANYONE else and won't be. But the government could easily and capriciously put me out of business without so much as a "Sorry!" because it wants to spy on people easily. And lots of disinformation spread around, to be sure. (and I mean you "you won't have to bother, just the big guys" types)

The solution is to just say no, in large numbers. We have a government that is out of control. They are also trying to tag every farm animal in the country and farmers are just saying no. Remember the anthrax vaccine the statists wanted to mandate? It died when "first responders," in large numbers, simply said no. The beast can be beaten.

I believe the point you are making is, if you have the knowledge to use the modern technology, you can do a lot.
But, NSA has a whole lot more knowledge. I do not mind that knowledge in the hands of conservatives, I do mind it in the hands of socialist liberals.

I see the "City Planet" in the last three Star Wars movies and wonder, for such a society to survive, how intrusive is government into the lives of the individuals. I can only imagine. But I suspect that if I live another 30 years and the US does not have a political revolution, I will find out.
I will also be living in another country, almost certainly.

You have a MAC address and CLID's that are only on your computer. Yes they would have to find your computer, but I would give them about 7 minutes to do that if they wanted you.
Believing you can beat them would be a big mistake. You may ride your neighbors connection, but that doesn't mean you are anonymous. If you were a high value target, you would be arrested before breakfast tomorrow. Riding your neighbors WiFi is one thing and threatening to blow something up is quite another.
The point of my post is trying to figure out why the article was written in the first place. This guy is upset because he is being made irrelevant. He wants to bring up the old bugaboo of "big government" to scare people into thinking he has a right to be in business to save us all from the evil empire. All I was saying is they already have the ability to listen to his customers whenever they want. The networks are controlled by other people and they are controlled by the gubmint. If ATT wanted to fight the government, they might have some licensing trouble in congress or maybe a rate increase problem, or the always popular, anti trust suit.

I'm not being "made irrelevant". I'm angry because the government is forcing its way into our lives...and at the same time taking over yet another industry and removing the ability of small business to survive.
What's more angering to me, is that so few care. Many in my industry are like "oh, well, don't object, that might make you unpopular with the government".
Many are to the point that they'll accept anything, including bankruptcy, rather than object to intrusion.

That's what encryption is for.
For years I've been encrypting anything that it is possible to encrypt. Figuring out which bit of traffic that comes out of my PC says, "Send me your brownie recipe," and which one says "Transfer the money to Mohammed," is going to be difficult. This is true for every security professional that I've worked with for the last ten years.
It's become true for many people that download from distributed networks because of the heavy-handedness of the RIAA/MPAA. All of the major distributed nets now support encryption. It's built right into their products and is increasingly incorporated into other products out of sight of the end user.
My mailserver, when it attempts to send or recieve mail from any other mailserver, first tries to encrypt the stream with TLS. My records indicate that about half of the remote mailservers that send me mail initiate an encrypted tunnel.
Mandating snoopiness will just cause more people to use encryption. The FedGov snoops will ask for, and be given, any data they want, but it will look like this:
