Fulton DA seeks charges in shooting of 92-year-old woman in her home
The Fulton County district attorney will seek felony murder charges against at least one of the three Atlanta police officers who shot and killed an elderly woman in a botched drug raid, according to one of the officer's attorneys.
Defense attorney Rand Csehy, who is representing Gregg Junnier, said he received an e-mail message from District Attorney Paul Howard's office today saying the DA would seek charges before a grand jury Feb. 26.
"It's an overbroad indictment," said an angry Csehy. He said that Howard's office has "broken with the federal government. Paul Howard is no longer part of a joint investigation."
Csehy said that his client had been cooperating with authorities.
On Nov. 21, three narcotics officers went to the home of Kathryn Johnston, 92, to execute a "no knock" warrant. A shootout ensued during which Johnston was killed and the three officers were injured.
"No knock" warrants are frequently issued so police can get inside before suspects can destroy or flush any drugs. When the officers kicked in the door, the elderly woman apparently got off five shots from her own revolver, hitting all three police officers.
Friends and family members of Johnston contended that she was a feeble and frightened woman, who rarely ventured outside after dark and knew few people. And they say that she was never involved in any drug activity.
The three officers, Gregg Junnier, Gary A. Smith and Cary A. Bond, were put on administrative leave.

Charge her with anything you want but when it was found out it was the wrong address or at least wrong information and she was innocent, all changes would have been dropped against her. Some one, cop or otherwise comes busting through my door is going to get their ass shot off. I’ll worry about charges later, if I live.

Those cops murdered that old woman and lied all over the place.
That isn’t a murder, it’s a screwup. That makes it manslaughter, at best.
No knocks are supposed to be executed only when you have good info that the occupants are armed with firearms and predisposed to using their weapons against law enforcement. You prove that to a judge by showing him the criminal history of the occupant(s) that list violent offenses and weapons charges. Flushing the dope is NOT a good enough reason for a no knock warrant in my state.
Look — THAT post was made WAY back on 2/7 of this year. I was accurately reporting what I had observed on the TV. I am not going to retract a statement/post made 2.5 months ago. Remember, I was making remarks based on what **I SAW AND HEARD** on Channel 5 in Atlanta.
A lot more info came to the forefront IN FACT over the succeeding weeks. There seems to be little question NOW that some (all?) of these cops lied. It would seem the old lady died for BAD reasons. No question.
The lady died wrongfully at the hands of the police force — some of whom (perhaps all of them) KNEW they did not have a good warrant, and then tried to cover it up when things went real bad. That’s what we appear to know now.

Speaking of Atlanta, I’m surprised the story about Michael Vick’s house being used to raise 60 pit bulls for dog fighting hasn’t been posted here at FR.

I read another article on this fiasco earlier today. The media is the media so who knows how accurate it is, but it sounds like the cops were committing perjury in order to get the warrant, and doing other nefarious acts that amount to felony crimes. That would make it murder. If true, they should be shot, all of their property seized and their families thrown out onto the street.

The fourth Amendment would also need to be ingrained into this morons brain.
Ever since FDR changed us (via his "New Deal") from a Constitutional representative Republic (where the individuals rights are absolute and he or she can whatever they please as long as they don't infringe upon the life, liberty, property of another) into a legislative democracy (where the individual has no rights only privileges that are granted to him or her by the majority), all judges can disregard our secured Constitutional protections and do as they please.
