As I watched these events unfold two years ago, I presumed that the Bush DOJ chose not to exploit these stories for reasons of national security. Although seemingly unrelated, both of these stories lead to the same larger secret, a secret that Berger risked his career to conceal, a secret that if revealed had the potential to destabilize the nation during a time of war.
As I have since learned, however, the Bush White House is not fully in control of its own Justice Department and FBI. In truth, the decision to protect Berger may have more to do with saving the Clinton legacy than with stabilizing the nation.

Bush continues to play this "more civil tone" crap while the Dem-seditionists throw more and more mud in his face, and are nearly ready to launch impeachment.
He should have gone after the NYTimes for leaks, even if there was no reasonable chance of conviction.
And he should have hit back HARD at these race baiting Democrats following the Hurricane Katrina devastation. SCREW THIS "FEMA WAS TO BLAME" bullcrap.
FEMA did as well as possible under the circumstances. It was the thieving Mayor Nagin and the ghetto attitudes which caused 95-percent of the problems in New Orleans.
Notice the other areas in Louisana and Fla. fared much better and are well on their way to full recovery.
Bush should have set a tone three years ago that the US was not gonna sit idly by while seditionist newspapers did the legwork for alQaeda types.
And he should have charged Berger.
And he should STILL specifically name and counter these hatemonger Democrat politicians who accuse him of lying, or worse.

Bush came into office with a Cowboy image, and has turned that into a Wimpboy image these past three years, and it turns my stomach.
And that wimp tone is a large part of the reason the GOP got drubbed so badly in '06. They were scared to fight the lamestream media. They were scared to fight back against near traiterous libs.
The thicket of Clinton hold-overs still rules the roost at DOJ. John Ashcroft was too civil to these shills. And Alberto Gonzales prefers them...

He was indicted and more. He plea bargained and he was convicted.
It's not "BS" about protecting secrets- that's the same reason Agee was never nailed as much as he deserved, the SOB pulled the old trick of calling every covert agent and anyone remotely related to covert ops as witnesses. Rather than expose agents and methods it was regrettable better to nail him with only the base evidence and not try for the big stuff that would open the proverbial can of worms, maybe get people killed, American and allied assets.
These weenies, evil unethical lawyers and really dumb emotional juries - the latter having "reasonable doubts" no matter how much evidence of guilt is presented - are the reason "secret evidence" rules were sought. Prosecutors know the odds of getting an inteligent jury are about nil so they won't take the chance and prosecute more difficult charges with greater penalties. But if we just had smart juries with a capacity for logic many prosecutors wouldn't have to open doors better left shut - they'd be able to work with the information available.
That said, there is no doubt the DOJ is corrupted- there are elements who become tenured over the years who will protect mafia-connected people ... and certainly the Clinton cronies are mafia connected as we know from Hillary and Harold Ickes. In the Berger case it is more likely his connections saved him, otherwise prosecutors would have made absolutely certain he was ineligible for any kind ofsecurity clearance. That they didn't extract this from him is proof the prosecutors were sympathetic to him or at minimum paid off.
That's my take on it. Also, the two chief reasons for this happening.
1) President Bush is too damned polite. But it's not the President's job to be polite to traitors. When you are president, you can't always follow your personal inclinations.
2) President Bush left too damned many traitors in the FBI, the CIA, and the Justice Department. These people still work for clinton, and therefore work against the administration, and therefore work against our country (not that they minded doing that even while they were in power).
I suppose reason #2 was also the mistake of being too damned polite, too ready to be bipartisan, when the other side is partisan to the core and couldn't care less if they betray their country.
The way Jimmy Carter came into office with a folksy sunday-school teacher image. It was (and is) all for show.

This Berger affair is utterly sickening. We are not angry enough, and we are losing America to criminals and traitors.

According to Wiki - "Berger eventually pled guilty to a misdemeanor charge of unauthorized removal and retention of classified material on April 1, 2005."
The sentencing judge raised the fine to $50K, added 2 years of probabtion, 100 hours of community service (tho' I bet that wasn't picking up roadside trash)and the 3-year clearance loss was left in place.
So my point remains. Unless something else is found (no pun - a new legal infraction), Berger has walked.
He's one of those environmental/public health nuts: no cigarette, and a vegetarian last meal.
Sounds like he got off with a hand slapping. If a Republican had done the same it would have been hysteria media reruns about justice blah blah blah.
Lets make sure this guy never has another government appointment.

There's a reason incoming administrations fire all of those who "serve at the discretion of the President". These appointees are products of their benefactors. Bush, in an effort to show he could work with the Dims, chose not to replace the Clinton people in a number of key bureaucracies...State, DOJ/FBI and CIA all come to mind and all have been a thorn in his side. But, even larger than that, the Dims control of Congress for 40 years prior to Newt made the DC based Feds products of the Dim's congress. They just outlast the Republicans when we do hold office and subvert all in the name of partisan politics...what's good for the country be darned.
