Illegal immigrant sues radio station for withholding raffle prize

A woman has sued a Spanish-language radio station in Chicago, claiming it refused to give her the Corvette she won in a 2005 contest because she is undocumented. Maribel Nava Alvarez, 22, said she was never told she needed to be a U.S. citizen or legal resident to win the car in a raffle sponsored by WLEY-FM.

Alvarez also claims in the lawsuit that an attorney for the station's parent company, Spanish Broadcasting System, threatened to turn her in to U.S. immigration officials if she tried to pursue the issue in court.

Alvarez, who said she has left the Chicago area out of fear that she would be deported, is suing for breach of contract and emotional distress.

If she won it, she should have it.

But insist that she take delivery at her preferred Chevolet dealer in MEXICO.

(so as to comply with IRS regulations on income which make it impossible to deliver in the US without documentation)

You need to be a citizen or legal resident so they can give you a W-2 and so you can pay taxes on the value of the prize. Every contest held in this country has that requirement.

If she won it under false pretenses, then she should not get it.

If the contest rules required that she be a legal citizen, or even a legal resident, she does not deserve it.

Often times, to win a car, the rules will require that you be a licensed driver.

It's called a 10-99 form, anything that valuable has to be submitted with a social security number so uncle sam gets his share.

The really funny thing is that the station who held the contest is the one who organized the 400K march last summer, they are total proponents of illegal rights. Now they are the ones choking on giving it to her because they can't write off the car as a business expense without one, I just love the irony here...

How can she enter into a contract if she's here illegally? By definition, she's in breach of contract, because she misrepresented herself.

I say they should call her and say that they have decided to give her the car. When she shows up to claim it, have INS grab her and deport.

Not that if really matters, but it was a used car that had belonged to a singer whose name I didn't recognize.

But, you're right. I'm sure that not only does she believe that she won the car fair and square, she also has no intention of paying ANY taxes on it.

Good point. They make money on ads that are in part, targeted to a percentage of the audience that is illegal. They also enjoy higher ratings due to illegals listening in.

Too bad, so sad. Give the lady her car at the border and watch her drive back into Mexico.

In most contests, where a car is the prize, the contestant is responsible for paying all taxes and licenses. I wonder how she was planning on paying for those.
