This week Durham District Attorney Mike Nifong could be slapped with more charges related to his handling of the Duke Lacrosse case.
This week the State Bar Council will be holding its quarterly meetings in Raleigh. During this time, the agency could add ethics charges against the Durham district attorney.
Nifong recused himself from the Duke Lacrosse case shortly after the state bar filed an ethics complaint against him last month. He's accused of misconduct for statements he made to the media last spring.
In a letter obtained by Eyewitness News, defense attorney, Joe Cheshire requested to meet with Nifong in March about the statements.
"I do not understand why you will reportedly speak to the media in such certain, condemning terms before all the evidence is in, but you will not have the courtesy to meet or even speak with a representative of someone you have publicly condemned," Cheshire stated in the letter.
Nifong could also face additional charges for withholding DNA evidence that was favorable to the accused players. Evidence that is now in the hands of the state's Attorney General.
"We accept these cases with our eyes wide open to the evidence, but with blinders on for all other distractions," Roy Cooper said.
The State Bar Council meets today.
The council will decide this spring if his public comments about the case were a violation of the professional rules of conduct. Nifong's ethics meeting is scheduled for May.
No Federal Probe
The U.S. Attorney General's office has responded to Congressman Walter Jones' request for a federal probe of the Duke Lacrosse Case.
In a letter delivered Thursday, Alberto Gonzales' office wrote that it would be, "Premature to initiate a federal investigation pending a criminal trial."
This means the Attorney General will not be getting involved in the case at this time.
Based on the 60 minutes interview, Durham District Attorney Mike Nifong is going to be slapped monetarily. Duke University Trustees should be worried about the endowmwnt. Probably the president and the 88 signatories should be taking steps to hide assets as well.
I question the timing. The feds stand down one day before Nifong recuses? Hmmmm..........
Is there a violation of Federal law involved or do you expect big daddy Fed to right every wrong, even if it's not on their turf? Maybe we could create a new Federal agency to investigate every fixed traffic ticket.
I'm not a states rights fanatic but having the Feds jump in this case now seems way premature and would be wrong. North Carolina has problems they need to fix on their own.
There have been more than enough violations of Federal, state and local laws to convict every politician in the state. Finding anyone with backbone to enforce the law is another story. That'w what NC gets when it elects the DemocRATS.

• sexual assaults;
• false arrest and fabrication of evidence;
• deprivation of property; and
• failure to keep from harm."
Oh, you mean UNlike all those cases where prosecutors were charged with misconduct by federal authorities? Now what were those again?
So what can they do at this point? Move their assets to some exotic place offshore?
Surely a local would be smart enough to keep a scalawag or carpet bagger from this office. Those were Republicans anyway.
Ditto is so into defending the treatment of the Duke players, I have to wonder if he/she is actively involved in the case on the side of the prosecution.
You are hearing the voices of those who FEEL something should be done by the feds. Laws don't matter to those FEELING this way. Precedent has no value to those FEELING this way. Federalist is just another concept of no use to those FEELING something must be done.
It would be a bone wearying task to go over the whole case with Ditto at this time and try to point out that Nifong should be investigated for wrongful acts committed within and beyond his authority.
Such issues are generally handled through STATE laws before the feds get involved.

So there is a federal law against having Too Many Strange People and Things Happening in Durham? What does ANY of that farrago have to do with the Duke boys?
Do you think it is "possible" that state law takes precedence in this matter? I do.. It's got to grind through the state.

The FBI has been asked to investigate the beating of a jail inmate, allegedly at the hands of guards.
Lake County Sheriff Roy Dominguez said six officers, who were not identified, have been suspended with pay.
Inmate Tommy Ford (pictured) was hospitalized following the Dec. 26 attack at the county jail in Crown Point. The sheriff declined to describe the extent of Ford's injuries.
For starters, how about learning about laws concerning feds and state? In some cases, the Feds can intervene; in other laws, the States have more power.
