Nifong a Topic at State Bar Council (and Feds Decline to Act for Now)

This week Durham District Attorney Mike Nifong could be slapped with more charges related to his handling of the Duke Lacrosse case.

This week the State Bar Council will be holding its quarterly meetings in Raleigh. During this time, the agency could add ethics charges against the Durham district attorney.

Nifong recused himself from the Duke Lacrosse case shortly after the state bar filed an ethics complaint against him last month. He's accused of misconduct for statements he made to the media last spring.

In a letter obtained by Eyewitness News, defense attorney, Joe Cheshire requested to meet with Nifong in March about the statements.

"I do not understand why you will reportedly speak to the media in such certain, condemning terms before all the evidence is in, but you will not have the courtesy to meet or even speak with a representative of someone you have publicly condemned," Cheshire stated in the letter.

Nifong could also face additional charges for withholding DNA evidence that was favorable to the accused players. Evidence that is now in the hands of the state's Attorney General.

"We accept these cases with our eyes wide open to the evidence, but with blinders on for all other distractions," Roy Cooper said.

The State Bar Council meets today.

The council will decide this spring if his public comments about the case were a violation of the professional rules of conduct. Nifong's ethics meeting is scheduled for May.

No Federal Probe

The U.S. Attorney General's office has responded to Congressman Walter Jones' request for a federal probe of the Duke Lacrosse Case.

In a letter delivered Thursday, Alberto Gonzales' office wrote that it would be, "Premature to initiate a federal investigation pending a criminal trial."

This means the Attorney General will not be getting involved in the case at this time.

Duke report draws retort from Durham
Manager: Police took case seriously

DURHAM - Duke University administrators appear to have based their response to rape accusations against lacrosse players on a cell phone conversation overheard on a hospital loading dock.

An internal report filed by a Duke police officer March 14, shortly after a woman told emergency room workers she was raped, says the accuser initially said she was attacked by 20 men before changing it to three men.

It also indicates that city police were skeptical that a serious crime had occurred, though it does not say which Durham officer made that assessment.

City Manager Patrick Baker said Tuesday that the Duke police report is based on what a campus police officer overheard a low-ranking Durham officer say on a cell phone early that morning outside Duke Hospital. The criminal investigation has been handled by Durham police.

"Their officer did not speak to our officer," Baker said. "He appears to have overheard half a conversation, and he didn't follow up."

Dozens or times a day. Bar complaints in Arizona resulting in suspension or disbarment are published and are very common.

A top Duke University official confirms that last spring, after allegations that a black exotic dancer was raped at a drunken Duke lacrosse player party made headlines, Duke Campus Police told him that when she and the second dancer first got there, unidentified white males inside were overheard saying, " Oh no. We're not going to f—k a nigger bitch."

Kim made no mention of this in her 60 Minutes interview, nor in her police statement. This must be coming from Crystal Mangum.

Cash "scooped" the reinstatement story which appeared on Jan 3rd.
Apparently the purpose of the scoop was to ignite the hellfire and damnation of blacks.

Didn't happen.

So now they hit the blacks over the head with a frying pan.

Maybe this was an attempt to playout on her "validity" of "word" because she was studying "criminal law"?

I gotta check back and see who wrote that article, and find out where that person was "educated".

Obviously Mr. "hurt me please/cage me up" Burness isn't all that involved with "education" that he'd pass onto others "hearsay" like that. How disgusting and disgraceful of him to do so.

He's either numnuts; or trying to prevent Karla from Resigning her TEACHING position. As I referred earlier, I wonder what her contract stipulates. If she quits based on "Duke" not defending her, does she still get in cash the rest of her contract "money" if she doesn't "teach"? And, another thought, by proxy, if he takes the heat, does this in some way defend Karla/Duke from being sued in civil litigation?
