Of course he does. He is a Democrat; and they are ALL above the law.

Just ask the US Attorney General.

He wouldn't have to recuse himself to do that. All he'd have to do is reassign it to someone else. As I understand it, he's asking to have a SPECIAL prosecutor assigned, which takes it completely out of his office.

I think he would lose support in his own office, among the ranks, if he tried to foist responsibility for the case (and its dismissal) off on one of his underling deputy DAs. What he's doing here has the look of being less cowardly.

I just wonder who he has in mind to take over the case. Nifong being out doesn't ensure anything right will happen. He may have prearranged a volunteer to "suggest" to the court, which of course is not binding on the court. It could be reassigned to the AG which probably isn't a whole lot better than Nifong keeping it, as far as the boys are concerned, that is. Cooper isn't going to want to alienate blacks because he wants to be governor, and he will protect Nifong because they are both rats. He might dismiss, but I doubt he would then file charges against Nifong or Mangum.

I can hardly wait to see who is assigned.

Dismissing the charges doesn't remove Nifong from legal jeopardy, no matter who dismisses them. If the AG gets the case, I don't look for criminal charges to be pursued through that course. The only recourse would then be the feds, and of course civil suits.

No. He's removing it from his office. If he was going to pass it to an assistant in his office, he wouldn't have to file to do that. Recusal, in this case, means his entire office is recused. It's not a re-assignment.

All witnesses, even victims, are subpoenaed to appear in court. This was standard operating procedure.

Nifong asking to be replaced is a BIG surprise to me. I think
one possibility is that he will not have to dismiss the case himself or be removerd by the Judge. If he survives the Bar trial without being disbarred he would still be Prosecutor and could say to constituents that he did all he could.

Given his outrageous behavior, I hope that courts rule that he's NOT covered by normal governmental protections againt being sued. This guy did things that no prosecutor should ever be allowed to do, and he needs to be made an example of.

I hope he loses everything he's ever owned.
