Sounds like a last-ditch (as in, the stern of the Titanic is sticking straight up in the air last-ditch) effort to salvage what's left of his case. Hopefully he won't be allowed to get away with it.

Nifong needs to be recused from the legal profession.

I am thinking Nifong was blindsided with the subpoena for Precious which was served by the defense. Someone had to tip off defense attorneys that she was in his office at the time.

WRAL has confirmed it now.

He's weaseling out.

This may prolong the case.

Durham District Attorney Mike Nifong has asked to be taken off the Duke lacrosse case.

Nifong sent a letter to N.C. Attorney General Roy Cooper this afternoon, according to Noelle Talley, a spokesman for Cooper. The letter asked the attorney general to appoint his office's special prosecution unit to take over the case, Talley said.

Nifong answered the phone in his office about 5:30 p.m. but refused to say whether he had asked to be recused from the case.

“I'm not sure where y'all are getting this stuff,” Nifong said. When asked whether he had sent a letter to the state attorney general he said, “I'm not commenting on anything about this case. Bye.”

Once recused, it becomes somebody else's problem.

I was wondering if Feb hearing may be postponed so new attys have a chance to "get up to speed" on the case.

It is possible that the case may be prolonged now because of this, but it is still good news, as it must surely signal the end game.

I'm glad to see it's true. Hopefully this will speed up the end of the agony the boys & their families have had to endure. And speed up the beginning of the agony for Nifong. As well as the end of his career.

Good for her - the legacy lives! I can't think of a better person to be on campus at this very moment. Will they listen?

King to students: You're better than that

By Stanley B. Chambers Jr.

Bernice King, the youngest daughter of Martin Luther King Jr., spoke before a packed crowd at N.C. Central University's McDougald-McLendon Gymnasium on Friday as part of the school's celebration for her father. Her message was more about how African-Americans can lift themselves up than about her parents' legacy. “We are so overtaken by selfishness, a spirit of greed, a spirit of sexual promiscuity that we’re passing a legion of immorality to the next generation,” she said to applause. “The reason I am challenging you to hear this is because as the old folk used to say, ‘you’re better than that.'” King urged the audience to not let others define them, to remind young people of their heritage and to not settle for the status quo. She spoke about the negative influences of rap music, how debt has overtaken the black community and how her father's "I Have a Dream" speech wasn't about him. "He was concerned about the next generation of leaders," she said. "That was his vision. And if your vision is just about you, then you haven’t started living." King's message inspired Harrison Howard to continue his education and volunteer more with youth. "It's good to hear someone who said, 'Continue the legacy that was started and for us to make positive changes,' " said Howard, 19, an NCCU freshman from Durham.

If he refuses to comment, then it's definitely true. This isn't something he'd have to conceal for any legal reason.
