A federal district judge in Shreveport has dismissed a lawsuit filed by unsuccessful congressional candidate Patti Cox challenging the residency of U.S. Rep. Jim McCrery and seeking to overturn the election results.
Such a challenge should be decided by the U.S. House of Representatives, U.S. District Judge Tom Stagg said.
"The House of Representatives is the only institution permitted by the Constitution to decide the qualifications challenge," Stagg wrote in a one-page judgment.
That was the position McCrery's lawyer as well as a federal magistrate who heard the case had also taken.
Cox has a challenge pending before the House of Representatives.
Cox, a Democrat, claimed in her suit that McCrery does not live here anymore and therefore does not meet residency requirements. She wants McCrery disqualified and the second- and third-place finishers -- the Rev. Artis Cash and Cox, respectively -- to compete in a second election.
Two years ago, McCrery sold his house in Shreveport and moved his wife and two sons to the Washington area, saying he was tired of being a part-time father and husband. He said he rents an apartment here and therefore is still legally a resident of district. In an interview last month, McCrery said up to half the members of Congress do the same thing.
McCrery in November handily defeated Cox and three others to win a 10th term in Congress.

Here's what I find to be interesting in the article. This points out very well the fact that most of your "representatives" in the District of Criminals don't even live in the state they are allegedly representing, and a large number haven't for years, if not decades.

What is their definition of "dismiss"?
Editors just don't weed out redundancy anymore!
When the judge refuses to hear a suit, and says "I dismiss it."
That's the usual definition.
That was easily solved by McCrery weaning himself from the political tit! Of course, he's addicted to power. I have no sympathy for him. I might sympathize for his constituents if they voted for someone else in the primary when he decided he couldn't quit cold turkey!
Sorry for my ignorance, but it appears from the reading to me that the judge is simply passing the case on to a more superior court and not dismissing the case.
He's a conservative republican. Two words that don't seem to go together much lately.

They are good. His being in Washington doesn't take away anything from us. I say let him stay close to the beast that is Washington, to keep a close eye on them.
