No biggy. The defense will get to question Miller and Russert on cross before Cheney testifies and all they have to ask them is if they had ever talked to Armitage before ever talking to Libby. If they say they had then that's reasonable doubt about Libby lied about being the first to disclose the info. If Russert, Miller or any other reporter try for the 5th then it's a he said they won't say, case tossed.

This case is a total waste of the prosecutor's time and our resources. He ought to be going after several people at the NY TIMES instead.

Libby also has sought a subpoena for the tape of Washington Post reporter Bob Woodward's interview with former Deputy Secretary of State Richard Armitage. Armitage has admitted he discussed Plame's job with Woodward in 2003 but said it was a passing, inadvertent comment.... The tape has been turned over to prosecutors, and Libby's attorneys said they expect no objection to their subpoena.

Maybe a freeper lawyer can clear something up for me - - why wouldn't Libby's lawyers already have this tape of a conversation between a reporter and a government official? Clearly, the tape is relevant and crucial to the defense, and obviously there is no threat to national security.

Ithink Cheney would perform brilliantly if asked. It doesn't sound like he's being subpoenaed, just requested to testify in Libby's behalf. Fitz would be outclassed by a country mile asking Cheney anything on crossexam.

When is Richard Armitage's frogmarch scheduled for? I really want to see that.

I mean a man who endangered Valerie Plame's life the way he did (destroying the secret life of a mother of twins!!), and Armitage ruined our national security. Boy I'll bet the indictment's taking so long because Fitz has to write a really long and strong speech berating him for making it impossible for good people to serve their country anymore.....
