his is not the way the system is supposed to operate. Prosecutors are supposed to be out for justice, not blood; committed to the truth, at all costs, not winning, without more.
Prosecutors arent just morally obliged but legally required to turn over exculpatory evidence to the defense.
Prosecutors arent just one side in a battle.
You cant come across the smoking gun covered with fingerprints on it come across it because you have the power of the state to collect all the evidence and then decide to ignore it because they dont match the fingerprints of the guy youre prosecuting for the crime. You certainly cant file the report from the lab for your eyes only.
You have to tell the defendant that the smoking gun has someone elses prints on it. He has a right to know that, and the prosecutor has a duty to tell him.
There is a reason that the rules are such. The prosecutor represents the people. The peoples goal is winning, which doesnt have to mean a perfect conviction rate.
The goal is supposed to be to convict the guy who did it, not frame the guy youve got.
Somebody should tell that to Mike Nifong. Or to the judge who is in a position to do something about who prosecutes the Duke lacrosse players charged with rape.
What is going on in the prosecutors office in Durham North Carolina is disturbing in ways that go beyond the ugly allegations that started this case.
The District Attorney has clearly lost sight of his mission, and with it the last remnants of any ethical compass. The case has been characterized, since the outset, by a clear failure to follow the offices own procedures and practices.

As far as I know, not even KC Johnson, a law professor, has called for Liefong's arrest.....yet. Nor has James Coleman, to my knowledge.

Further, you've never displayed one iota of knowledge about the CJ system, investigation procedures, criminal procedures, what happens on the street or in a courtroom or behind the scenes, so I do not believe you. You seem to be claiming that your work as some functionary in immigration (by the way, it's called "ICE" now) after working as some functionary in some other federal bureaucracy is real LE. It is not.
I already know you're not a nice person. Perhaps that contributes to your other problems.
Whatever the case, I hope your situation improves but that you choose someone other than me to burden with it so you will have a fresh start at not alienating those who would ordinarily be compassionate and sympathetic to the circumstances.

Here is a story not reported. My son was a junior last year, and is a friend of Reade's. Three of this frat brothers are on the team. I was at Duke that spring to pick him up, and everyone was very upset because the Duke administration had told the LAX boys they had to get off campus immediately because the Black Panthers were coming and they might be at risk.
Instead of telling the Black Panthers to get [redacted], they made these boys move out of their dorm, DURING exams. I listened to a boy talking to his dad on his cell phone trying to explain why he had to move out. I have never been so mad in my life.

Yes it is stand proceedure to compare the DNA with everyone who is known to have handled it. The company has a data base of DNA and probably ran the profiles against it. In fact if you remember during the discussion of the claimed partial match to Evans there was some number of others in the companies DNA data base that that DNA sample also could be claimed as a partial match.
I think that sentence was missing a "not." I think you will see that corrected eventually.

Let's start with the team parents, who should be furious with their sons for blowing their season and embarrassing their school. And yet apparently not one parent, not one, has said to her son, "you go in there and tell the police the truth about what happened."
Yes, I know the Fifth Amendment says criminals don't have to talk. I teach criminal law. But what are we dealing with here? The mafia, or a sports team from a first-class university. Instead, they hire them lawyers to trash the victim and the prosecutor.

Duke Case: Failure of Procedure
There is a scandal now brewing in the Duke lacrosse case. I'm not even sure whether to call it a rape case anymore. You're about to see why.
Consistent with the procedure in North Carolina and elsewhere, the prosecution has to turn over its evidence to the defense to prepare for trial. There's still more to come, but the bulk of what has been turned over is troubling enough. It suggests a failure to follow standard procedure that is rather mind-boggling.
...thereby proving the old saying that there's a first time for everything.
